Driveways in D.C. Now a No-Parking Zone

Beverly Anderson is mad as hell. She just started to get tickets for parking in her own driveway.

That's right. The District of Columbia is ticketing people who park their cars in their own driveways. ----

So what does the law say?

"Any area between the property line and the building restriction line shall be considered as private property set aside and treated as public space under the care and maintenance of the property owner."

Basically what that means is most property owners in the District don't own the land between their front door and the sidewalk, but they are responsible for taking care of it. It's why you can get a ticket for drinking beer on your front porch in the Nation's Capital. You're technically on public space. It's also why the city can ticket you for parking in your own driveway

I criticized too quickly - apparently the DC government will let you lease your own driveway back for only a few thousand dollars per year. /sarc

Hey, start writing tix for smoking in the area and you might increase revenue, a little, since in America we now marry fags, we don’t smoke ‘em. (at least not in public, not yet!)

THAT is a "taking" by any measure.

Too bad for the 'rats in DC. They know not about where to get pitchforks and torches much less what they are and to what uses they can be put.

If I were a 'rat (snowball's chance..., etc.) I get the heck outa there in a heartbeat.

What is the reason for not allowing people to park in driveways? The purpose of driveways is for car parking. Do they put “no parking” signs up? If not, how can they issue tickets? The whole thing is absurd. Makes me want to cuss someone out! I can’t believe where this nation has gone in the area of no common sense. I think this must be some kind of joke, or someone is trying to make a point.

If this stands they could ticket and prohibit all kinds of things. Christmas decoration on what effectively is public land, even though it used to be your front yard? Think of the money they could raise or the people they could put in jail.

They’ve even ticketed their own congresswoman.

Wouldn’t your front porch necessarily be behind the building restriction line. Therefore how could this law be the reason you can be ticketed for drinking on your front porch?

And bust people for drinking on their property, too.

Here in MA, someone I know got popped for DUI AFTER they pulled into the driveway, turned off the car, got out and and were entering their house.

This is not unheard of, the campus police on the university here in town are notorious for ticketing students who live in student housing for not having a parking sticker, or visitors who don’t have a sticker.

Hm, so the Government wants you to pay it for using your own property? What does this say about our government?

Congressional privilege is only applicable while IN one of the houses, or traveling to/from them... Sorry, but that doesn’t count all the time you’re away from the House.

I don’t think it matters how long the stupid law has been on the books. You can’t “take” property without just compensation. If this was private land and the DC Council passed a law to this affect, it can be easily fought in court.

I’m not a lawyer, but this is why we have a Constitution. (or at least why we used to).

On the other hand, if it was public land and sold to private owners with those restrictions, then it is a different story.
