The Right of Rebellion

“That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.”

Many will recognize the above from the Declaration of Independence. With the TEA parties fresh in our memories and the words of our Founding Fathers still ringing in our ears a new American Revolution is being discussed in many quarters. The American Revolution, as embodied in the Declaration of Independence, established and legitimized a right of rebellion in both natural law and positive law. The threshold to which the people judge and act upon the destructiveness is subjective and is to be determined by “we the people”, not the government, the courts or the media. The caveat and caution is that they be successful in their actions. History is written by the winners and has not been kind to failed revolutionaries. Those in power are cautioned to remember that trash heap of history and hell are both filled with those who misjudged the fine line that separates outraging the American people from enraging them.

The American Revolution, as embodied in the Declaration of Independence, established and legitimized a right of rebellion in both natural law and positive law. The questions I put before the Freepers are:

· Is the right owned and exercised individually or collectively?

· Does the right to cast off an unacceptable government also creates a duty to do so?

· Is the right subject to restrictive conditions before it becomes effective, such as that the right exists only in the face of tyrannical government?

Right wing extremists have a lot of nerve preserving, protecting and defending the Constitution that politicians swore to do but have not done.

The questions are a few years out-of-date in terms of relevance and are, therefore, not worth debating at this point.

At this stage we already exist in a tyrannical state far worse than the Founders envisioned, albeit softly/stealthily imposed rather than by physical force.

A third uprising would only be successful if it starts within a segment of the military, followed by a popular uprising. Or if a segment of the military joins onto a popular uprising.

Bottom line, the Commander and Chief would have to lose control of a substantial portion of the military.
