WASHINGTON – A federal appeals court has ruled that a Marine cannot sue Pennsylvania Rep. John Murtha for defamation.

Staff Sgt. Frank Wuterich of Meriden, Conn., claimed Murtha damaged his reputation by saying he and his comrades killed women and children "in cold blood" in Haditha, Iraq, in November 2005.

Murtha argued he has immunity from the lawsuit because he was acting in his official role as a lawmaker...

Our court system is in ruins. I doubt we will ever repair it.

It was the job of the Republican Party to defend the honor of our military. Instead they decided to remain silent.

Marvelous—a lawmaker is exempt from slander, defamation of character and sheer outright lies, especially against our military. No wonder every leftist wants to get elected!

Obviously, Murtha paid of a corrupt judge for this decision...

Oh, wait, I'm not a lawmaker doing my “official duties”!!! Hope I don't get sued by Murtha and the judge!

Hmmm...I thought that that immunity was only for statements made on the floor of the House, and not outside the building to reporters.

Marine can't sue Murtha

Perhaps not. But he can kick his ass...and I hope he does.

Hey, if you’re a public official you can lie and impugn the honor of anyone without recourse. You can also call your own constituents red neck bitter clingers and get re-elected. Is this a great country or what? /s/

Then if he was acting in his official capacity to defame the soldier he can be censored and removed from the House of Representatives. The Republicans should demand his ouster and let the Democrats spend the next six months defending his despicable actions.

Well, I guess the Marine will simply have to go to Plan B.

“It is the job of the Republican Party to defend the honor of our military. Instead, they decided to remain silent.”

Quite true. Conservatives really have no representation right now, I can’t think of a single U.S. Congressman that I trust. So therefore, we have to act on our own, collectively. And aggressively.

How about an old fashion duel? That is how loud mouthed traitors like Murtha used to be taken care of. Anyone remember the Sumner Caning Incident. I’m a South Carolinian. We will never forget it.

All they have to do is pay off the court clerk who assigns the cases to judges. The court clerk probably assigned that judge because the judge was sympathetic to Murtha.

Yet another case of overt judicial misconduct in the service of a political agenda. Or did Murtha just give them money? This SOB was NOT acting as a legislator when he slandered our Marines. He was bloviating on TV, in an agit-prop campaign designed to give aid and comfort to America’s enemies. The judges’ position means that Members of Congress are mini-Sun Kings , above the laws that bound the rest of us. What bastards these people are!

The corrupt court system - just another one of the boxes of liberty closed up by the left.

However, I agree with this one. A congressman should be able to say whatever he wants on the floor without having civil or criminal penalties.

His constituents need to take care of the problem and vote him out. If they don’t, they should be the subject of national ridicule.

Paula Jones can take a President to court. What makes Murtha so special?
