Even racist speech is free speech. Do we really want to intimidate the press out of free speech, even racist speech, by invoking the full weight of the federal government to intimidate the utterer of the speech? Do we really want to chill free speech, even racist speech, at this price?
Do we really want the government with its monopoly of power and violence, with all its great ability to intimidate through tax and licensing regulations, to be at the irresponsible disposition of the likes of Reverend Sharpton? Are we not thereby empowering Sharpton to engage in legalized extortion? Are we sure that we can control the likes of Reverend Sharpton and protect not just the press but every private citizen? I cannot invoke the criminal and quasi criminal apparatus of the federal, state, and local governments whenever I am aggrieved, can you?
Should we let a private citizen of dubious motivation define for the rest of the world what is free speech and what is not, what is politically correct and what is not, what should bring down government upon us? Even if the cartoon were racist-and it is not-a civilized and lawful society should require that that determination not be made by some race baiter off the street but only by lawful authorities whose jurisdiction is invoked when and only when there is reasonable cause to believe that a crime has been committed and the defendant, committed the crime.
I can think of no more pernicious practice entering into our criminal justice system than to permit and extortionist like Reverend Sharpton to precipitate criminal investigation when no crime has been committed, merely because the Reverend believes that the object of his agitation has committed racism.
