Man Who Killed Wife Gets Minimum Sentence (Yep. He's Illegal!)

Julio Marin-Garcia, who told a judge Wednesday he still doesn't recall stabbing his wife to death, will spend at least 20 years of a life sentence in prison -- the minimum for a first-degree murder conviction -- before he can ask to be released.

Dane County Circuit Judge John Markson told Marin-Garcia, 28, who stabbed his wife, Yuliana Hernandez-Hernandez, to death at a Fitchburg apartment in October 2007, that as a young, ambitious, hard-working man with no criminal record, it is possible that he will pose no danger to society if he leaves prison in 20 years.

"The greatest punishment is not what I do but having this on your conscience," Markson said.

The period for extended supervision eligibility that Markson gave to Marin-Garcia was the shortest in a Dane County domestic abuse-related first-degree intentional homicide case since Wisconsin's Truth In Sentencing law took effect in 2000.

Assistant District Attorney Corey Stephan, citing the sheer brutality of the homicide -- which Marin-Garcia recorded on a digital voice recorder -- the apparent forethought given to the crime and Marin-Garcia's refusal to take responsibility for it, asked that Markson never allow Marin-Garcia to petition for release from prison.

"There is no other way to describe it," Stephan said. "He butchered her. He killed her in cold blood while she begged for her life."

Marin-Garcia was convicted of first-degree intentional homicide after a trial in July.

In 2004, Roger O'Neal, 43, was sentenced to two consecutive live terms for killing his stepsons in Madison. His eligibility for extended supervision was set at 50 years. Thomas McCants, 26, convicted in 2005 of killing his girlfriend, Lizzette Fountain, was told to wait 27 years before asking for release from prison. And Walter Fudge, 56, who shot his ex-girlfriend Tina Campbell to death in 2005, was given 24 years before he can petition for release.

Patti Seger, director of the Wisconsin Coalition Against Domestic Violence, said it's her sense that judges in Wisconsin tend to give shorter sentences to domestic abuse-related homicides than other homicides, even when the manner of death is similar between a domestic case and a non-domestic case.

That pattern, she said, is particularly true in Wisconsin's larger urban areas but less so in smaller counties, where public outrage at the rarer homicides is more concentrated.

"It's just more of a message to the community," Seger said. "What the message does say to the community is that the victim is somehow culpable."

Marin-Garcia's attorney, Assistant Public Defender Jon Helland, asked that Marin-Garcia be allowed to petition for release in 20 years, also noting that as an illegal immigrant Marin-Garcia will be deported to Mexico when he leaves prison.

Marin-Garcia's brother-in-law, Rene Hernandez, said Marin-Garcia destroyed the lives of his family, and those of the couple's two young children, by killing Yuliana Hernandez. He called Marin-Garcia "heartless."

Marin-Garcia responded later that he was not heartless because he feels sincere remorse for what he did. But said he does not recall what happened after arguing with his wife.

"Many people can't understand what happened. They will never know," he said. "They just go by the theory of what probably happened. But I am sincere when I tell you that I don't remember what happened at that moment."

We just had a guy today in my hometown sentenced to 60 years, 10 suspended, for killing his wife. And he plead guilty in a plea agreement. Of course, this guy wasn’t an illegal.

This sentence is racist. You can’t charge foreign nationals under laws like this. They are different. Our laws don’t apply. Hell, he should be able to marry again and again, kill them all. It’s just not right for us to apply our rickety old laws to fine upstanding people who are only looking for a way to support their families. This report really saddens me. Obaaaaamaaaaaaaaaaaaa, can’t you pardon this guy? Where’s La Raza, MALDEF, the chapters of MECHLA? Where is the Democrat party on this?
