Police: Homeowner justified in shooting intruder

Fayetteville, N.C. — Police said Thursday that a homeowner who shot and killed an intruder last weekend wouldn't face criminal charges.

Jerry Riley, 54, of 593 Tokay Drive, said a stranger confronted him as he entered his home Saturday night. Riley said he pulled a handgun on the intruder, and the two men then struggled over the gun.

The gun went off, and the intruder took the pistol and ran out of the house, police said.

Officers investigating the burglary found Joshua Caleb Pratt, 27, of 662 Glenola Drive, in the street with a gunshot would to the abdomen. He was taken to Cape Fear Valley Medical Center, where he died.

Excellent.

Now the homeowner just has to hope the Obama Administration won’t prosecute him for depriving the criminal of his civil rights....

The bullet went in the other fellow, so that’s a passing grade. But he only gets a C-, as weapon retention is an important part of self-defense.

The castle doctrine should be automatic for anyone facing off against intruders in their own home. No inane requirement to retreat - rather take the intruders out permanently.

My GF’s mother use to live on that street before she passed away 3 yrs ago come March. It’s right off of Ramsey St. on the right headed out of town. That address is 4 houses up from hers across the street.

I would think anybody would defend their home and family with their life at the front door.....maybe liberals would have problems with this. They would be conflicted....He won’t hurt me....

Well, the criminal made off with the homeowner’s gun. Still, I gotta give him a MAJOR FAIL rating.

Agreed! What if the homeowner had just wounded him? You’d have a living miscreant with a gun. Retention of the firearm is probably most important factor (and good aim) in dealing with the criminal.

I went once to the local police dept. and they told me that in the event of a break in I would have full right to use “whatever means I deem necessary to defend myself.”

I thought it was. I mean it's your own home... if you can't have any measure of safety or sovereignty there than you are nothing more than a pawn or slave.

Castle Doctrines are legislated by state, and unfortunately not all states in the US have a Castle Doctrine. I happen to think they should. Iowa, Virginia, Wisconsin, Oregon and
New Mexico are a few examples I know that don’t have it.
