Holy Land Foundation case puts burden on Muslim charities

American Muslims are finding it more difficult to donate money to help Palestinian refugees and other Middle Eastern causes because of court decisions showing that some charities were using the money for terrorism.

On Nov. 24, the formerly Richardson-based Holy Land Foundation and five of its organizers were found guilty in a Dallas federal court of sending millions of dollars to Palestinian charity committees controlled by banned group Hamas.

A week later, the 7th U.S. Circuit Court of Appeals in Chicago delivered another blow, upholding a $156 million civil judgment against Holy Land, which had previously been found liable for the death of an American-Israeli teenager, David Boim, killed by Hamas gunmen in 1996.

"This creates a fundamental Catch-22 for all U.S. charities and grant-makers that do any kind of international work," said Kay Guinane, a lawyer who monitors legislative and regulatory effects on nonprofits for OMB Watch, which advocates openness in government.

"Either you risk having your group shut down, your funds frozen and your leaders prosecuted by providing aid in international hot spots where people are neediest, or you stay away to stay safe," she said. "Neither choice is acceptable for a society that prides itself on its respect for human life."

Writing on Dec. 3, 7th Circuit Judge Richard Posner echoed Holy Land Foundation prosecutors when he argued that one need not directly put money in militants' hands to be responsible for their actions.

"Anyone who knowingly contributes to the nonviolent wing of an organization that he knows to engage in terrorism is knowingly contributing to the organization's terrorist activities,"

Only in America would somebody actually care about the success of charities catering to the enemy’s civilians.

This makes an overall positive comment about the true greatness of America: that such naive people are tolerated and unharmed and at-large in the American version of Democracy is an amazing thing.

It also raises an interesting question: when was the last time Hamas or al Qaeda donated to, say, the American Red Cross?

Giving money to terrorists is insane, Kay. Advise your clients not to do it, otherwise they may end up in court.

Not a Catch-22, they are not mutually exclusive!

A little background on "Muslim charity" is in order.

Muslims are required to contribute 2 1/2 % of their wealth and income every year, with an exemption of the equivalent of 3 oz of gold. For low-income Muslims without stock/bond portfolios this is a negligible amount, for wealthy Muslims this is a significant hit (remember, it's a tax on assets not just yearly income).

As to who is entitled to receive zakat, yes the poor are entitled, but so are people who are engaging in Jihad. See Islam Online

It's in the Quran that zakat must be paid, and that Jihadis must be paid from zakat. There's no getting around it.

How about you choose only charities that stay completely away from terrorist-infested zones such as Hamastan.

There are countless millions, even billions, of FAR FAR needier people in the world anyway.

Unless your real aim to funnel money to Hamas, Hizbullah, et al.

Thanks for the ping Meek. If they want to support terrorists they need to go live where the terrorists are.

In my town there were incidents of Islamic doctors laughing and whooping it up after 9/11. I know it for a fact as I learned from another doctor. But our newspaper denied it!

I’m sick of people being afraid to speak out about things like this, of the MSM hiding it. If they are supporting terrorists something worse than just stopping contributions needs to be done!

I don’t contribute to The United Way because some of it filters down to abortionists.

See my post #10. It is a Quranic requirement that zakat (Islamic “charity”) must be paid by those able to pay, and it is also a Quranic requirement that those engaged in Jihad MUST be funded from zakat. An Islamic charity MUST fund jihad in order to be in compliance with the Quran.

I saw your earlier post about it being a Quranic requirement for them to fund the terrorist, PapaBear.

It presents a problem for them, doesn’t it? Just as the Bible presents a problem to those fighting the illegals.

I, myself, am against ILLEGAL immigration just as I am against funding terrorists.

President Bush is an everyday Bible reader and I believe this is at the heart of his failure to control illegal immigration.

BUT, Jesus also tells us we must obey the laws.
If we are willing to obey our laws, then muslims living here must obey the laws of our land or move elsewhere.

Many won’t like my post, I realize that.
