Hate to be pessimistic but caution is in order. This is the CA Supreme Court after all.
They may be setting it up so their (second) overturning of the voters' will appears fair.
I suspect they have made up their collective mind already so procedural issues and who's arguing what won't really matter in the end.

Voters will not have to solely depend on Attorney General Jerry Brown to defend the measure. LOL! Kind of like the wolf guarding the sheep pen. Sanity appears to be prevailing in this matter.....for now.

If the Court was persuaded the opponents could win on the merits... or demonstrate likelihood of success, a stay would have been granted. As it is, its very difficult to overturn a constitutional amendment. Sec. 7.5 will take effect as soon as the Secretary Of State has certified the vote next month retroactive to November 5th.

How does having this go to court help the proponents of Prop 8, and why are they happy about it?
Doesn't that just give the judicial tyrants the opportunity to strike it down as unconstitutional?

These are all good sign, but these attempts to force gay marriage on the People by judicial fiat are not over. Also, we still have Gays Gone Wild calling for revolution.

The Supreme Court has accepted original jurisdiction of three cases that claim Proposition 8 is a constitutional revision rather than a constitutional amendment and thus should not have been presented to voters. Interesting logic there - the platiffs are arguing the SCOCa "revised" the Ca Constitution with their ruling that allowed for homosexual marriage last spring.

Can Supreme Court justices be recalled?
And if so, can such a recall be done en masse, for all who rule against Prop 8?

Because there are serious issues that should be resolved. The Left of course doesn't like to lose. But it helps to have the law settled when lower courts have to apply it to cases that will come before them in the future. The courts job is to interpret the law, not to make it.
