Sure it wasn’t under a Williamson Act long term open space contract? If so, the owner has agreed to keep it in open space in exchange for a tax break. It takes from 10 -20 year to get out of the contract. Earlier out must be in the public’s interest.
Doesn’t sound right. It is such an obvious takings unless there is some flood hazard or other factor (like protected habitat) they are using to prohibit other uses and development. If it is habitat, there is a new case (I believe it is Casitas Municipal Water District v. United States, Case No. 2007-5153 - Fed. Cir. Sept. 25, 2008) that ruled a taking of property (water use right) for diversion to the benefit of an endangered species. http://www.cafc.uscourts.gov/opinions/07-5153.pdf This brings up all sorts of new 5th Amendment possibilities.

This has been going on for a number of years. I have not been following it closely, but IIRC the county has managed to block any proposal which made economic sense for the owners. The local political climate is notoriously 'no growth'. The property sits between current housing and the freeway, and on alternate days, county personnel will wax eloquent on the 'desperate need for affordable housing' in the local area.
