Vice presidential Candidate Wiley S. Drake Sr. to file in court asking to de-certify Barack Obama because he has refused to release proof of being a Natural Born Citizen, thereby disqualifying Obama in his bid for the Office of President.

The recent Lawsuit in Washington State demanding their Secretary of State to vet the citizenship credentials of Barack Obama has spawned a slew of similar suits with new lawsuits filed and/or prepared in WA, FL, NC, CO, CA, OH, FL, CT, GA, TX, MI. Related lawsuits HI, US District.

As part of this effort, this group of citizens from states across the union made an outreach to the whole presidential slate asking each candidate for president and vice president to offer up a certified copy of their birth certificates and any related candidate declarations to be placed in a library made available to the public via a non-partisan web site.

At least one VP candidate Wiley S. Drake Sr. went the next step and agreed to file a lawsuit of his own to demand the disqualification of Barack Obama unless he can prove status as a ”Natural Born Citizen” as the constitution and federal statues demand and define.

In another unrelated action, though also aimed at forcing Obama to release proof or step down, 24 potential Electoral College electors are filing action Monday morning in court also demanding proof. A call is herein being issued to any elector in any state, especially democrat electors who would like to join that effort. Electors interested in adding their name to this lawsuit can contact Mr. Marquis who will put you in contact with the attorney handling that case.

Potential lawsuits regarding the "Natural Born Requirement" by plaintiffs with standing at the 11th hour?

Wiley S. Drake Sr is the VP candidate listed on Alan Keyes ticket with the America’s Independent Party

The press release doesn't give any info about the electorals home states or the court information on either of Monday's upcoming filings.

IIRC, Steve Marquis, recently had his personal lawsuit dismissed in WA state for his lack of standing.

The way this reads these citizens are demanding the various Secretary’s of State ask for Obama’s birth certificate. What if the Secretary’s of State just say no they won’t ask. Case closed, right?

Constitutionally, electors must have standing in court since they actually vote for the president.

Actually, one could argue that without proof of his eligibility to serve as President, the electors would be bound to vote against NObama, i.e. they have a remedy that doesn’t require judicial intervention.

Would they legally be able to do this even if Obama won the vote in their state? Has this ever come up before?

What’s the big deal about showing a birth certificate? Why doesn’t obama just show the damn thing already and be done with it.

My understanding of one of the reasons for electors is that they were to have final say because many Americans at the beginning of our nation weren’t educated enough to make good decisions. Sadly, that still applies. Perhaps the only reason the Electoral College is still around is the other reason, to balance small states vs. large ones. Electors can vote however they want, although they usually appear to echo their states’ majority vote.

When you vote for President, you are voting for a slate of electors. If Obama wins your state, the Obama electors get to represent your state in the Presidential election. Given our current partisan environamnet, they would vote for Obama no matter what, even if there is evidence that he is not a natural born citizen.

He believes he doesn’t have,and that his word should be good enough.When I joined the Army I had to have a copy of my birth certificate.My word wasn’t good enough.

I bet Obama would send his thug lawyers after any elector that didn't play ball. Didn't I hear somewhere that all these law suits were dismissed? The one on this guys web page was just filed 11-1-08.

The Constitution does not say that the remedy is to not vote for someone who may not be a natural born citizen. It says that they not eligible to become President. It is not against the law for one to vote for them but they cannot become President. If you want to you can vote for your dog. We have the Constitutional right guaranteed to us that we have a natural born citizen as our President. It was written into the Constitution for our protection against having a President with divided or other loyalties. Obama is a prime example as he said he would side with Muslims if there was a choice. He promoted a candidate in Kenya who was against the right of our country to extradite known terrorist against our country. His loyalties are all over the place.

Yes. There's been rogue electors in the past who have voted for the other candidate. Some states have laws that punish electors who do this...but such punishment would be after-the-fact, and there's some question as to whether these laws are even constitutional, i.e. whether the state has the power infringe upon the elector's powers.

Yes but doesn't the Secretary of State have to certify the election? If the electors go rogue, the SOS might just refuse to certify the election for that state.

Because it is a lose-lose deal for Obama.

If he was born in Kenya to an American Mom then he is not a natural born citizen but a naturalized citizen like Gov. Schwarzenegger.

If he was born in Hawaii but adopted by the Indonesian Lolo Soetoro his complete records would show this also. This would imply Indonesian citizenship that he probably never denounced making him an illegal alien like his aunt in Boston.
