Voter-protection group sues Kaine, other Va. officials

A national voter-protection organization has scheduled a press conference for 10 a.m. today to discuss its lawsuit against Gov. Timothy M. Kaine and other top Virginia election officials on behalf of the Virginia State Conference NAACP.

The organization is accusing Virginia of an unconstitutional allocation of polling-place resources in Richmond and several other urban areas.

Judith Browne-Dianis, co-director of the Washington-based Advancement Project, cited a survey by the organization that determined that minority precincts have too few voting machines and election officials.

"Virginians are going to turn out in large numbers, and election officials must act quickly to make sure their failure to prepare doesn't become a barrier to voting," said King Salim Khalfani, executive director of the Virginia State Conference NAACP.

The suit, claiming that inaction by the state violates the Equal Protection and Due Process clauses of the 14th Amendment to the Constitution, was filed in U.S. District Court here by the Hill, Tucker & Marsh law firm.

State election officials say they have added more voting machines and more election officials since 2004 and that the state is well-prepared for a high-turnout election. They say the Advancement Project's information is flawed.

Advancement Project is asking the court to issue an order requiring Richmond, Norfolk and Virginia Beach to reallocate voting machines, or use paper ballots.

Clearly posturing...so they can challenge the vote if it is close and get a liberal judge to rule in their favor....Liberals don’t care about the rule of the people, they want to bypass the legislative branch and let their friends in black robes give them everything they want.

Not only that, but this could have implications for 2009 if AG Bob McDonnell has to defend Kaine and the state.

Kaine is a Democrat. He was considered for Osama Obama’s VP. Why would he supress the black vote? This is just a setup to keep polls open late to allow people to vote more than once.

NAACP asks for federal takeover of Va. election

The Virginia NAACP has filed suit in U.S. District Court in Richmond demanding that the federal government be put in charge of the Nov. 4 election in Virginia.

The complaint, naming Gov. Kaine as a defendant, alleges that the state failed to prepare for an unprecedented turnout of voters in the presidential election. The Associated Press reports that the complaint asks that the court reallocate voting machines to precincts most likely to have long waiting lines and to keep polls open for an additional two hours.
