The outcome would be a little more straightforward—though not necessarily more politically satisfying—if the candidate dies between the general election on Nov. 4 but before the Electoral College votes on Dec. 15. There's no federal law that mandates how electors must cast their votes; theoretically, if the candidate to whom they were pledged dies and their party has not made a preferred successor clear, electors can vote for their party's VP candidate, a third-party candidate, or a leading preconvention contender within their own party. Under this scenario, however, individual state laws have the potential to make things murky, given that each state has the power to determine exactly how its electoral votes are to be cast and distributed.

Bonus Explainer: What if the candidate dies after the election but before the inauguration on Jan. 20? The 20th Amendment states that if the president-elect dies before beginning his term, then the vice president-elect assumes his or her spot. However, the point at which a candidate officially becomes "president-elect" is debatable. He or she definitely assumes the title after Jan. 6, when a joint session of Congress officially counts the Electoral College votes and declares a winner. But the shift could be said to occur immediately after the Electoral College vote.

What if the President elect is found to have been ineligible fr the office of POTUS? Would that not invalidate the entire election?

LOL! This is more anti-old McCain propaganda. You bring up the more important point. What if the PRez elect is an Indonesia citizen, born in Kenya and who is an illegal alien? I doubt it. They would go to the VP with the most votes. That would be Biden if Obama was elected.

If you haven’t done it, read the whole article. It raises the issue at different times in the process. If someone cannot serve after the election but before the Electoral College casts it votes, the electors can choose whom they want. It wouldn’t necessarily be Joe Biden (if Obama is found to be Kenyan). It could be................................................................................HILLARY!

Sorry, that is correct. Before the electors vote, it is whomever they want. They are, at that point, representing their party/states. My guess is your right, it would not be Biden ;)

After they vote, it would, constitutionally, have to be Biden.

hmm maybe that’s why hillary is camapigning for Biden. obama wins, biden takes over, he’s too old and creaky so hillary runs in 2012

Problem: we’ll have socialism and we’ll *still* have riots by all the metrosexual Obama supporters.

If it came down to the electoral college because The Messiah was ineligible, I think they would give it to Hillary, not Biden.

I hate to say it, but Hillary and Biden would probably work very well together for Hillary’s causes. Unlike Obama who will probably discard Biden after the election (if he wins, which he will not)

In the novel I never finished from 10 years ago (darn it), I had a Hillary character blackmail the VP nominee a few weeks before the election and take his place. She became VP and you can guess what happened next.

well the creepiest part of this whole campaign was when there was this rumor that Biden would drop out of the race due to health reasons on oct 5 and on oct 5, he actually stopped his campaign for a few days because his mother in law passed away.

Well, to answer the question, Joe Biden as president will turn out to be the most corrupt whitehouse in history! For starters...
Joe Biden will probably have many stripper parties on record before his term is up...

Oboma is NOT going to be deported...EVER....and if he were elected and found out he's not a citizen, WHO would remove him....NO ONE.....they would all be afraid of the RIOTING and UP RISINGS that would follow.....we would have President Obama.
