Exactly... They don’t need permission to use their song. They probably could demand money for using it, but that’s about it.

You are correct. It’s being used no differently than being played at ANY party or dance. Now, Van Halen did the same thing when the campaign used their song “Right now” in an ad. That was a legitimate gripe.

But did anyone notice that that same song was used throughout the convention even after Van Halen decried it’s use?

They don’t own the song, Capitol Records is the copyright clamiant on the song.

Nope. Fair Use applies to the use of copywrited materials for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. Not political campaigns.
