Bischof Law: Government Abuse of U.S. Citizens Gone Wild!

The "Cindy Bischof Law" has the potential for victimizing innocent Illinois fathers and may spread nationwide.

The Bischof Law is a draconian measure that will allow judges to order anyone, mostly men and fathers, to wear a GPS tracking device if they are simply considered to be at a high risk for domestic violence without being found guilty of any crime.

There is a presumption of guilt without the benefit of a trial, yet the foundation of our criminal justice system is that a defendant is presumed innocent until proven guilty.

Perhaps such a drastic measure would be warranted if the men forced to wear the devices had fair trials and were found to be guilty of violent or dangerous crimes.

However, the Bischof Law empowers judges with the ability to mandate the GPS tracking device on anyone who is accused of violating an order of protection without being convicted of the violation - and orders of protection are widely granted with minimal evidence of the potential for violence.

In the 1970s, orders of protection (also commonly referred to as "restraining orders") became a tool to help protect battered women. However, in the rush to protect the abused, the rights of the accused have been violated on a large scale.

According to the Justice Department, two million restraining orders are issued in the United States.

The vast majority of these are related to domestic violence allegations, yet research shows these orders often do not even involve an accusation of actual violence. All that is needed to obtain an order is a claim that the person to be restrained "acted in a way that scared me" or was "verbally abusive" - what's known as "shout at your spouse, lose your house."

Such orders have become so commonplace that the Illinois Bar Journal calls them "part of the gamesmanship of divorce."

Electronic tagging devices can be appropriate as a condition of parole or probation. The Cindy Bischof Law goes far beyond this, placing long-term electronic tags on men who have never been found guilty of any crime.

One day, these judges will find they pushed the buttons of the wrong person.

I hope, for their sake, they are ready to deal with the consequences of their actions.

Yup, but the precedent was set when the courts ruled that it was okay ex post facto to make registered sex offenders wear these bracelets.

In order to apply these anti-sex-offender actions retroactively judges rule that they aren't punishments. Well, since the law then says they aren't punishments, the requirements can be applied to others without being found guilty of any crime.

"When they came for the Jews..." We Americans are giving up more and more of our rights for illusions of security, sold to us by snake-oil demagogue politicians intent only on promoting their power. Like the Germans in the 1930s we will deserve every bit of what we get because we have no compunction whatsoever about "doing unto others" in the false belief that it will not be done unto us also.

That started up in the early 1990s, just as soon as the new federal child support laws were passed. Judges and lawyers were both getting shot with some regularity. At first, it was covered on national news - but feminist groups protested - comparing it with "negotiating with terrorists." So, the media stopped reporting - or misreported when they did report (i.e. cause / motive: unknown).

Fortunately or unfortunately, depending on how you look at it - the fathers' rights movement has had a great deal to do with lesser violence in response to the laws. There's a hope out there - perhaps it's been a false one - based however on sincere efforts - that non-violent, organized political action might get results. And I suppose people like me - who have written many articles on fathers rights - help people emotionally because at least someone is recognizing and speaking out about the problems.

Anyway - this stuff is going to continue to happen because those making it happen are getting tens of billions from federal coffers every year. I suppose any losses they suffer in their own ranks are considered acceptable.

This is the primary reason why I will not get married or get “intimate” with a female. There is NO twenty minute ride on the planet that could POSSIBLY be worth all of the hell and misery I’ve seen other men go through.
