Artist hit for refusal on beliefs

An evangelical Christian photographer was brought before the New Mexico Human Rights Commission after she declined for religious reasons to photograph a same-sex commitment ceremony.

When Elaine Huguenin of Albuquerque, N.M., declined in September 2006 an e-mail request from a lesbian couple to photograph their ceremony, one of the lesbians responded by lodging a human rights complaint with the New Mexico Human Rights Division, the state agency charged with enforcing state anti-discrimination laws and sending cases to the commission to be adjudicated.

Oh, sure, I was wrong, I e-mailed them that immediately. I said I wanted to film their ceremony in 2006, and in fact, if they want to invent time travel, I’ll go right back there and do it right now.

I’m sorry, I have the freedom of speech, and that freedom of speech has implied benefits, not just freedom of association, but the freedom to choose /not/ to do something. I didn’t do it, and I could care less what this moronic commission decides. Goodbye.

The photographer’s human and constitutional rights are being denied; the complaintants are not guaranteed the services of this particular person.

This is something that a Canadian Province can get away with. However, in the U.S., this action has blatantly violated her First Amendment rights.

She needs a vicious lawyer to sue the State of New Mexico, each individual member of the New Mexico Human Rights Commission and all the horses they rode in on. The families of the Duke Lacrosse Team could recommend a few good legal barracudas for the job.

Vanessa Willock sought an injunction to prohibit Mrs. Huguenin and her business, Elane Photography, from declining any future request to photograph a same-sex ceremony.

Hmmmm...isn't it unconstitutional for a state to impose contracts on private businesses?
