Border search of Muslims was lawful, court says

NEW YORK (Reuters) - U.S. customs officers did not violate the constitutional rights of five Muslim U.S. citizens returning from Canada who were detained and subjected to searches usually reserved for suspected terrorists, a court ruled on Monday.

The U.S. Second Circuit Court of Appeals panel upheld a lower court's decision that said the searches did not invade privacy rights and were in the government's interest in preventing potential terrorists from entering the United States.

"We agree with the District Court that the government has a compelling interest in protecting against terrorism," the panel said in its decision.

The five Muslims, who had no criminal records and were not individually suspected of terrorism, said their privacy and religious rights were violated when they were questioned, patted-down, fingerprinted and held for hours in Buffalo in December 2004.

Whats 4 hours out of your life compared to 3000 dead non Muslims are you not Americans ? we all Sacrifice something in this war on terror 3000 gave all unknowingly more are overseas giving all knowingly so you can still be American [ if thats what you truly wish to be ! ] you were not attacked or beheaded like your counterparts are doing all over the world you were inconvenienced for a time

On the other hand they could very well have been some of those 1500 AQ released on promises not to jihad within the kingdom. Better safe than sorry.

The way I read his post, it appeared that he was stating that these moslims should shut the hell up with the complaints about being held.

Air travel now days is a pain in the ass because of the “Religion Of Peace” and they can take their “concerns” and shove them up their Muhammad.

The plaintiffs had initially sought to stop the government from carrying out similar future searches and to expunge all the data the U.S. government had collected as a result of the searches.

The group was represented by the New York Civil Liberties Union and the Council for American-Islamic Relations.

Why am I not surprised?

What’s with latest whine, you can search old men and women, young children, diapher bags, pocketbooks, body search whom ever you desire, water bottles but not muslims.

Which of the above make up the vast majority of terrorists?

Seems like a no brainer to me.
