LAKE CHARLES -- DENVER -- Ward Churchill will file a lawsuit against the University of Colorado on Wednesday. He is challenging his dismissal as a professor from the institution.
University of Colorado regents voted 8-1 Tuesday to accept school president Hank Brown's recommendation to fire him. CU Regent Cindy Carlisle had the lone dissenting vote.
Ward Churchill and his attorney, David Lane, plan to file suit in Denver District Court. Churchill is the first tenured professor that the school has ever fired for scholarly fraud.
Lane plans to amend Churchills existing lawsuit against the school. It will now seek Churchills reinstatement, a financial settlement, and demand that the university pay the attorneys fees.
Churchill is filing in Denver instead of Boulder because he says they'll get a more diverse jury in Denver, and a speedier trial than if they filed in Boulder. Churchill was dismissed because an investigation found that he misrepresented the effects of federal laws on American Indians, that he wrongly claimed evidence indicated Capt. John Smith exposed Indians to smallpox in the 1600s, and claimed the work of a Canadian environmental group as his own.
After the board of regents' vote, Brown addressed the media saying the university had no choice but to terminate Churchills employment after allegations of plagiarism and academic misconduct were deemed valid.
COMMENT ON THE FIRING OF CHURCHILL
"This case is a very clear example of an effort to falsify history and fabricate history," Brown said
The individual involved did not express regret or apologize or refrain from this kind of falsification in the future."
The announcement of the board of regents' 8-1 vote to fire Churchill came at 5:30 p.m. Tuesday. It was greeted with loud boos and shouting from a gathering of Churchill's supporters.
The fired professor called the decision a fraud. His attorney said the lawsuit they are filing is based on the First Amendment. It alleges the university is punishing the former professor for controversial speech.
The investigation of Churchill began after a 2001 essay surfaced in which Churchill compared workers in New York City's World Trade Center terrorist attacks to Nazi architect Adolf Eichmann.
CU said the action against Churchill was not related to that paper, because it was covered under the rights of free speech.
But it did touch off a 15-month long investigation into some of Churchill's other work. The investigation started in 2005, and ended with the findings of plagiarism and academic misconduct..
A five-member faculty panel voted 3-2 to punish, but not fire, Churchill.
In May, however, CU president Hank Brown recommended that Churchill be fired. Governor Bill Ritter and former Governor Bill Owens both supported Churchill's termination.
Will the judge say “Sir, when you are in my courtroom you will NOT wear sunglasses.”
basically what churchill is arguing for is
no academic standards.
you can make up what you will and pass it off as scholarly research.
Ward Churchill on the warpath?
What he is say is he can speak without repercussion. His speech and we have no say in what we can do about it.
I am sure the board knew this when it voted he would do this so I hope they counter sue for all legal costs.
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
Let's see... Congress... um...
Don't see nuthin' in there about universities.
Sorry, Charlie.
If you are going to be a fraud, now is not the time to go all wobbly.
Brazen is as brazen does.
And what the heck, he might win.
... and you will wash your hair.
Adios tonto
Churchill is a fraud and a wuss.
He’s doing this to be a nuisance and hopes to get a monetary settlement from the college to just go away.
The college needs to inform him that they will vigorously defend themselves and will expose him for the fraud that he is and has been.
That would be really be educational to all concerned.
>> Will the judge say Sir, when you are in my courtroom you will NOT wear sunglasses.
Hopefully!
And, with “Sir” a mere placeholder for a term or phrase that is much more descriptive of this POS...
Its like Aerosmith states
(That, that) Dude looks like a lady
About time this phony Indian got his just deserts. What a pain in the a... he will be in the months to come....Too bad...
>> Hes doing this to be a nuisance and hopes to get a monetary settlement from the college to just go away. The college needs to inform him that they will vigorously defend themselves and will expose him for the fraud that he is and has been.
You nailed it.
This lawsuit will be the dumbest thing the dumb@ss has ever done, in a career loaded with dumb@ass stunts.
No way can he prevail: he was hung out to dry not for his provocative views, but rather for his academic dishonesty.
If CU fails to defend the lawsuit I will be major upset.
I took a good look at him, he looks like he could use a good bath, a shave and a new outfit from good will. Keep smoking Churchee, one more nail in the coffin!

Why bother? Any of the Ivy League schools would be thrilled to hire him as a full professor...
Even though the odds are enormous for somebody that wins the lottery, Mr. Churchill’s odds of dying in a car wreck, are better than that. Hope is alive in me.
The University should counter sue him for fraud and collect his previous payroll and grants.
IIRC it was organizations outside the college that exposed his plagiarism.
Has anybody asked Churchill lately what tribe he’s from? It would be a hoot to hear him sidestep around the question, the way liberals do so often these days. And if he gives a straight answer, I bet the tribe mentioned will deny he’s a member.
Not that I'm inclined to be sympathetic to his view, but I think I understand it. From his perspective whatever the investigation found is irrelevant because it was motivated for the wrong reasons. The idea being that he would not have been caught if he hadn't been outspoken on other issues.
It seems that to the radical left the one unforgivable sin is to expose the sin of others. Thus I'm sure that in his universe he is pursuing a courageous and righteous coarse of action.
That's good to hear my ursine cousin, I presume this will undermine his suit (based on this layman's intuition at least).
He has already named the tribe...the tribe has already said he’s not from our tribe.
He is only an honorary Indian so he can only go on the honorary warpath.
Excellent post.
thanks.

Just one dirtbag defending another.
I hope the State of Colorado and the federal government prosecutes him for fraud when he lied that he was an Indian to get the State job.
Freedom of speech is a given, but there are consequences. Welcome to the real world.

“Waiting to hear his fate, Churchill won a small battle: He told a radio talk show host who had been one of his biggest critics to get out of his face. The radio guy had a live microphone and Churchill’s comments went out over the airwaves.”

Just great. UMass-Amherst just started looking for a new chancellor. How much you wanna bet...
Anyone else out there that think, as one of the loony left’s poster children, its a sad thing that he got fired? He did more to clarify what the left thinks than any of the obfuscating dem politicians that represent the left ever could. He is the left. He has a big mouth. The left cringes every time he opens said mouth. That is a good thing.

The picture did not copy but why do Ward “The Imposter” Chirchill and John “the want to be” Kerry look so much alike?
Maybe Harvard can insult Indians by starting up the school again, with Ward Churchill as the dean. (Dennis Miller had a pithy Indian name for Churchill last night on BOR, but I can't recall it.)
My husband is a tenured college professor and as a former chair, he has had to deal with problems of tenured professors. He thinks Churchill has nothing to lean on here and will fail in his suit. Let’s hope.
Here's a link somebody pointed me to yesterday: Churchill05
thanks, i read that this morning in the print edition.
hank brown is correct.
