House Judiciary Committee approves contempt resolution against Bolten and Miers

The House Judiciary Committee, in a straight party-line vote, approved a contempt resolution against White House Chief of Staff Josh Bolten and former White House Counsel Harriet Miers, setting up a constitutional battle between the Bush administration and Congress over executive privilege.

After several hours of skirmishing over whether to send a contempt resolution to the House floor, the committee voted by a 22-17 margin to approve the measure.

Speaker Nancy Pelosi (D-Calif.) and other Democratic leaders will now have to decide if and when to hold a vote by the full House on the resolution. A vote could take place as early as next week, said Democratic insiders.

This is what happens with a democratic controlled Congress, disaster, witch trials, propaganda spewing and third world truth telling. I heard here on FR several times before the 2006 elections, it would be good for democrats to be in power to teach republicans a lesson. I was one of the freepers saying it would be a disaster. I guess we can tell those calling for change in Congress at the time here were dead wrong and those that attacked the republicans MORE THAN the democrats in the media, like Michelle Malkin, Rich Lowry and others should be proud of themselves.

They are trying to create campaign fund raising opportunities.

They also are trying to find a way into White House documents and Emails to do a fishing expedition.

If Bush wanted to, he could legally fire everyone and it is legal for any reason he wanted.

The people mostly know this now, so what is the payoff for Democrats, go get below 16% approval ratings?

Arlene is really an ass. Now he’s saying he’s going to review the testimony of Roberts and Alito to see if their rulings are consistent with that testimony. What an idiot! What about the separation of powers now? Congress is just disgusting.

Contempt of Congress is probably not pardonable, although the subject has never, to my knowledge, been addressed in a court.

Joe Bolton is a man with brass testicles and a true American hero. The leftists and Bolsheviks in the Democrat party have demonstrated QUITE WELL in their first year of control that they are incapable of putting the good of America above petty partisan politics.

They are more than willing to engineer a military defeat for America if a military victory can’t be used for their own advantage. It should be clearer and clearer to the American public that the Democrat Party has become a monster in the bosom of the nation which is far more dangerous and vicious than any force we are opposing overseas.

We CAN take out Al Quaida, capture or kill Bin Laddin, prevent another attack on American soil, and win the war against Islam.

But we cannot do it with Democrats pulling the strings in Washington, preventing preemptive action, second guessing military operations, undermining the military by forcing the administration to enact “rules of engagement”, forbidding us to take the war to the enemy wherever it is, and forbidding the military from treating these pirates and fanatics like the kinds of menaces they are rather than as conventional soldiers fighting for a legitimate nation.

Before we can beat the Muslims, we need to defeat the Democrats and RINOs.

Congress is trying to make Presidential aides (or in this case, former aides) testify in front of the House and Senate Judiciary Committees. The President is refusing, claiming Executive Privilege protects the independence of the Executive Branch of Government. So the Dems are attempting to enforce their subpoenas by threatening criminal charges of Contempt of Congress.

Not necessarily true. It depends on whether you're looking at statuatory or inherent powers of contempt.

The Rats don’t want it to go to court because they’ll lose based on the Constitution,

“and he shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.”

The only way the Rats would have a case is if some wacko judge rules that congress is not part of or representing the interest of the United States.

I have always heard that a presidential pardon has no bounds.

I may be wrong, but I believe most scholars argue the pardon power is limited to judiciary offenses. The President has no power to pardon actions of Congress like findings of contempt or impeachment. But there's no point arguing this... let's just sit back and see how the Supreme Court rules if as and when this comes up for decision.

Contempt of Congress is an offense against Congress, not the United States. Not saying I agree with that, but that's the argument the Rats will use.

Congress is part of the US, and if one can be imprisoned for contempt of congress, one can be pardoned.

If the citations win support in the full House, they would be forwarded to the U.S. attorney for the District of Columbia — a Bush appointee.

And that's as far as it's likely to go, the Justice Department said in a letter to the committee late Tuesday.

Conyers and company are pissing in the wind!
