The video looks as though it could have been shot at almost any sleepy corporate seminar in the country, with one camera panning between a man in a suit and tie standing at a podium and others seated nearby. But the dialogue is riveting: It's a group of lawyers openly discussing strategies for helping their clients pretend that they're trying to recruit American workersas required by lawwhile they, in fact, hire cheaper foreign workers.

I work in silicon valley. This is standard stuff from the law firms and HR. No hype. It’s how corporate America follows (or in this case, doesn’t follow) the law. It happens every day.
(Thankfully, I easily found a non-tech job since Phoenix is a hot market right now. Some of my friends weren't so lucky.)
You do not have to show an inability to hire U.S. workers for an H-1B. You only have to show that the position is one that normally requires a professional (someone with a 4 year university degree) and that the person you are hiring has the applicable degree and any license if required. You also are supposed to be paying the prevailing wage. (The problem is that the additional number of workers being admitted to do the job keeps wages suppressed - basic supply and demand).
Showing that there are no qualified U.S. workers is under the PERM which is for employment based permanent residents and not the H-1B program. The H-1B program is temporary skilled workers while the PERM is the greencard process.
I would have expected a little more basic research from Businessweek.

After I disbarred their law license, seized their law firm assets,I would RICO them into perdition and send the results to every law firm in this area of the law and the former clients. Along with a fish wrapped in a newspaper of course.

No, it’s because the CEOs of Intel, Microsoft, et al are in the forefront demanding higher caps on H1B visas, and voila, those CEOs are all Democrats.
