FREEDOM OF EXPRESSION--SPEECH AND PRESS

Adoption and the Common Law Background

Madison's version of the speech and press clauses, introduced in the House of Representatives on June 8, 1789, provided: ''The people shall not be deprived or abridged of their right to speak, to write, or to publish their sentiments; and the freedom of the press, as one of the great bulwarks of liberty, shall be inviolable.''1

The special committee rewrote the language to some extent, adding other provisions from Madison's draft, to make it read: ''The freedom of speech and of the press, and the right of the people peaceably to assemble and consult for their common good, and to apply to the Government for redress of grievances, shall not be infringed.''2

In this form it went to the Senate, which rewrote it to read: ''That Congress shall make no law abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble and consult for their common good, and to petition the government for a redress of grievances.''3

Subsequently, the religion clauses and these clauses were combined by the Senate.4 The final language was agreed upon in conference.

It seems apt, in light of Senator Lott's observation, that we look at and even study, the FIRST Amendment to our Consititution.

Specifically, as Madison first submitted this on June 8, 1789:

''The people shall not be deprived or abridged of their right to speak, to write, or to publish their sentiments; and the freedom of the press, as one of the great bulwarks of liberty, shall be inviolable.''

I think we are having an effect. They can pretend this Amnesty bill is a done deal, but...why is Sen. Lott so upset if he has managed to push this through? Keep calling guys.

I doubt it- I think Lott is much loved by his constituents. We’ve got our hands full here in Florida as it is with Mel Martinez and Bill Nelson!

I was just so startled by Lott’s comment(s) that I couldn’t resist a REMINDER. Not sure just what he has in mind when he says “we must deal with the problem...”

I was so embarrassed for Trent Lott when he crawled on his belly to Black Entertainment TV and they did not forgive him. Bush, Frist, and Rove made of fool out of that boy and he took it. He is a very weak man.

What is the most significant thing that happened during the impeachment process that the country doesn’t know about but should?

I think the most important factor that the public should know that they don’t know is that, before we ever appeared on the floor of the United States Senate, the House impeachment managers and I were told that there was no way we could win.

HE:
Who told you that?
S:
Six Republican senators. Members of the leadership.

HE:
Members of the Republican leadership came over to you?
S:
No, we were over there. We were discussing the kind of method by which we would try the case, and we, the managers and myself, were told, “Look we’re just trying to keep you from embarrassing yourselves.” I mean, this is after a vote of the House of Representatives impeaching the President.

In that same meeting one of the senators -- and because I do not know which one it was, I will not name any of the senators -- turned to Henry Hyde and he said, “Henry, I don’t care. No way are you going to get 67 votes.” This was before anything had occurred on the floor of the Senate.

And Henry Hyde said, “Well, you know Senator, we have other materials over there in that room that were furnished by Mr. Starr and I think that some of them may have to do with assaults or things like that. And the senator said, “Henry” -- this is a direct quote -- “I don’t care if you have proof that he raped a woman, stood up and shot her dead, you’re still not going to get 67 votes.”

At that point I raised my hand and I said, “Senator, are you telling me I just watched a hundred senators raise their right hand to God and swear to do equal and impartial justice and that they will ignore that oath too?” And the senator said, “You’re darn right they are.”

Thanks, SE Mom. It seems freedom of speech only applies when we agree with them.

The arrogance that is on display in our government is horrifying. I always feel a little sick when I hear one of them say how “priviledged they are to serve the American people”, which is the last thing they believe or do.

immigration. Many offices are putting calls straight to voicemail and
they can just trash faxes (and letters take weeks to get through due
to security). Let’s hit Hill staff where they are so codependent -
their Blackberries. Send email directly to staff - not just the
generic Senator’s mailbox. Contact their Chief of Staff, Legislative
Director, and Press Secretary. Make your voice heard!!
