It would still be the decent thing to do.
I would expect that as soon as Libby asks for a pardon he will receive one. My guess is he hasn’t and won’t until the appeals process is over. But if the judge (is it Ito? or at least Ito-like) gives him ANY jail time then perhaps Libby will ask for the pardon before he has to serve any time.
