I'm a little shakey on this but I'm pretty sure it is, unless the suspect has consented. If Lindh did, then it ought to be easy for the government to prove; otherwise, they risked having all the evidence gained by questioning him thrown out. They must have some proof of consent, if consent was given.

He's in prison and I have heard nothing about appeals. That's proof enough for me.
