Threatening a flight crew member is (and should be) a criminal offense. But this is a misapplication of the Patriot Act, in the same vain as the misapplication of the RICO statutes by federal prosecutors.
No sympathy for this couple, but the proper laws should apply.

unfortunatly the law has not "motion to dismiss because the person in charge was a butthead."
How many people run afoul of the law just because they did not massage the ego of some badge holder?
