Air America WISE GUYS GET A PASS from Eliot Spitzer

October 7, 2006 New York -- Six officials of the Gloria Wise Boys and Girls Club stole $1.2 million from the group, money meant for needy kids and seniors, a city probe has found. Investigations Commissioner Rose Gill Hearn calls it "disgusting" - the worst case of wrongdoing by a non-profit contractor she's seen since taking office.

Thank goodness the thieves will be going to jail for a very long time - and paying back every cent, and then some.

Well, actually, that's not quite true.

In fact, nobody is going to jail.

Not even for a single day.

And the crooks get to keep most of the cash they stole. Four weren't even charged, and after a few brief years, the two who were charged can return to nonprofit work - to loot again, perhaps.

For that wrist tap, thank Attorney General Eliot Spitzer, whose office prosecuted the case.

Something is wrong with this picture.

Elliot Spitzer can't win in court and the only thing he has ever been able to prosecute are his own headlines.

no question about it...the lib/dems in NY just seem to be as dumb as stumps...well hell, they voted in "stumps" for senator and will re-elect her and try and fail to vote her back into the white house!

"Charles Rosen, a former executive director at the Gloria Wise Community Center, and his former assistant director, Jeffrey Aulenbach, face charges of grand larceny and obstructing governmental administration. Rosen was also charged with forgery.

New York City's Department of Investigation, which investigated the nonprofit for two years, said the men improperly took more than $290,000 from the organization for their personal use, on top of their already unusually large salaries."

I'm terribly sorry about this, but you're wrong. Here are the two key passages from the NYT article you linked:

Yesterday, Charles Rosen, 63, the executive director of Gloria Wise from 1993 to 2005, and Jeffrey Aulenbach, 46, the former deputy director for operations at the charity, pleaded guilty in State Supreme Court in the Bronx to grand larceny and obstruction of government administration.

and

Mr. Rosen and Mr. Aulenbach agreed to make restitution of $38,575 and $32,363, respectively, and to pay a $5,000 fine each, according to the state attorney general’s office, which prosecuted the case. The plea agreement, entered before Justice John N. Byrne, bars them from working at a nonprofit group for three years.

In other words, between them, Rosen and Aulenbach stole $156,587, of which they have to repay $80,938, or about 52% in fines and restitution. They received no jail time and this plea agreement apparently immunizes them from further state prosecution. Eliott Spitzer really did a great job of giving them a sweetheart deal from which they are able to keep $75,649 of the money they stole for their personal use. Disgusting.

The Post's editorial is dead on right.

You could take it either way; my remark certainly wasn't meant antagonistically. What's really disgusting is that Spitzer is giving everybody involved in this massive fraud a delousing criminal bath and immunization against suffering any real penalties. He's the next thing to an accessory after the fact. The only real hope (fat chance!!) is that the IRS will go after these pieces of two legged human filth for income tax evasion.

That is hopefully an alternative - that the IRS will step in. Also, it's too bad that the judge in the case accepted the deal. It stinks. Eliot Spitzer - rough tough crime fighter - yeah.

Spitzer's a rough, tough crime fighter except when some of his lib buddies are the criminals. Then he becomes their accessory aftet the fact, enables themn to keep alomst half of their loot, and makes sure they won't suffer any real punishment at all.
