Child pornographer wanted since 2001 caught in Salt Lake City ('King of Child Porn')

SALT LAKE CITY (AP) -- A man wanted since 2001 for sex offenses in Iowa was arrested in Utah after a suspicious landlord doubted his Social Security number and called the FBI, authorities said Wednesday.

Kirk Swearingen, 45, likely won't be returning to the Midwest. He was indicted on charges of receiving and possessing child pornography after agents examined compact discs in his computer case.

"He's here now, and we have federal charges. We would certainly like to keep him," said Melodie Rydalch, a spokeswoman for the U.S. attorney's office in Salt Lake City.

The mandatory minimum sentence for receiving child pornography is 15 years in prison. Swearingen was in custody awaiting a detention hearing Thursday. Defense attorney Viviana Ramirez could not immediately be reached for comment.

After riding an Amtrak train to Salt Lake City from California on Sept. 15, he attempted to rent an apartment under a different name and supplied a Social Security number that actually belonged to a 91-year-old man, FBI agent Jeff Ross said in a court document. The landlord called the FBI. Agents interviewed Swearingen and caught him in a series of lies about his name, date of birth and Social Security number, Ross said.

After fingerprinting him, agents found an arrest warrant from Jasper County, Iowa, where he was charged in the sexual abuse of two minors five years ago.

"He was just ever so nice and accommodating. ... We could have been targets," landlord John Daley told KJZZ-TV.

Swearingen also is wanted in Rapid City, S.D., where he was charged in 1994 with a sex offense involving a minor, Ross said.

His criminal history includes a conviction for sex offenses in Colorado in 1983, the agent said. Swearingen declared himself the "king of child pornography" but denied possessing or making it, Ross said.

In 2002, four months after the Iowa charges were filed, FBI agents there filed documents in federal court accusing Swearingen of fleeing that state. He was described as a trucker who had used 40 aliases over 20 years.

First, kudos to the landlord for being on the ball!

The guy used a false SSN. Yet the legislature, last session, refused to require the State and businesses to verify SSN's of those it employs for fear of losing some of the illegal immigrant workforce and being called racists by the illegal immigrant lobby.

I wonder how many other fugitives are out there living a happy life with someone else's SSN.

I'll post a couple more stories here with some other details in a moment.

Perhaps someday we'll all collectively go sane and start executing these people instead of warehousing them. But probably not.

'King Of Child Porn' Busted On Arrival In Utah

(KUTV) SALT LAKE CITY - Utah authorities have arrested the self-proclaimed “King of Child Porn,” who was apparently tripped up by an identity theft scheme.

Police learned about Kirk Alan Swearingen, 45, after a Salt Lake City couple alerted them about a man wanting to rent a unit in their building – whose name and social security number seemed a little suspicious.

According to John and Betty Daley, who own an apartment building, Swearingen called them two weeks ago from San Francisco. He told them he was coming to Utah and was looking for a place to rent.

But Betty got suspicious when he gave out his social security number. She did some detective work and found that his name and social security number didn’t match.

The Daleys agreed to rent an apartment to Swearingen, and called the FBI. When the suspect showed up to claim his apartment, he was arrested for identity theft.

However, after further investigation authorities discovered that Swearingen has previously been arrested as an accused child sex predator. It turns out, he was wanted in a variety of states and had been on the run for 22 years.

“We could have been targets for this animal,” John Daley told 2News. “We are nice people. We would have let him into our lives. He could have abused our children too.”

The idea that Swearingen could have set up shop in Salt Lake City is painful for authorities to think about.

“He is one of the worst possible predators,” said Brett Tolman of the U.S Attorney’s office. “He’s very aware of what he’s doing. And he’s systematic.”

“We are concerned that he’s traveling throughout the country, either possibly molesting children… or being involved in production or distribution of child pornography,” Patrick Kiernan of the FBI told 2News.

“I got butterflies thinking about how close of a bullet we dodged,” John Daley added.

Investigators say they have found several CDs in Swearingen’s possession that contain child pornography. The suspect reportedly has used more than 30 aliases over the years, and officials say he was very good at deceiving people.

The FBI says at the current time, it is unclear exactly how many crimes Swearingen may have committed across the country – but he has previously been arrested in Colorado, South Dakota and New Mexico.

Absolutely kudos to the landlord.

Also hope they can keep him in jail for more than the minimum of 15 years for one count of child pornography. Catching and keeping those people who produce child porn is just as important as catching and keeping the people who buy it.

FBI nabs suspect in child porn (SL Tribune)

A California man who allegedly tried to rent a Salt Lake City apartment under a false identity was indicted Wednesday by a federal grand jury on charges of receipt and possession of child pornography.

Investigators say the man's true identity is Kirk Alan Swearingen, a 45-year-old former truck driver who is a fugitive wanted in Iowa on state charges of sexual abuse for allegedly molesting two minors in 2001. He is being held without bail on a federal charge of flight to avoid prosecution.

Swearingen was arrested Friday after an apartment complex owner suspected he was giving her a false Social Security number and called the FBI Identity Theft Task Force.

At first, Swearingen insisted to investigators that the Social Security number, which belonged to a 91-year-old man, was his, according to an affidavit by FBI Special Agent Jeff Ross. He then gave another fake name before finally revealing his true identity, Ross said.

The affidavit alleges that Swearingen described himself as the "king of child pornography" but denied having any illegal material and gave permission for a search of his belongings. Agents found compact discs containing numerous images of minors engaging in sexual acts, Ross alleges.

If convicted of the federal child pornography charges in Utah, Swearingen faces a 10-year mandatory minimum prison term on the possession count and a 15-year mandatory minimum sentence on the receipt count. He could get a maximum of 40 years.

The FBI affidavit says Swearingen's record shows a 1983 conviction for a sex offense against a child in Aurora, Colo.; a failure to appear in court after being charged in 1994 in Rapid City, S.D., with a sex offense against a minor, and a 1998 arrest in Gallup, N.M., on a charge of possession of child pornography. The disposition of the New Mexico case was unavailable.

Another FBI affidavit, filed in the Iowa case, said Swearingen also has a record of burglary and larceny. In addition, it alleged that Swearingen had used approximately 40 aliases in the past two decades.

Hopefully they will put him away for life. There has to be much more than one count. Also, look at all the states he's gone through (that we know of so far): California, New Mexico, Utah, Iowa, South Dakota.

I wonder what he's been up to in each state...I shudder at the thought.

This law sounds odd - If someone emails (or snail mails) me a kiddie porn image, I can goto jail for 15yrs?

I suppose the devil is in the details, I hope receiving actually means "willfully and knowingly accepting" it.

On the news cast, they stated that he has done both. Apparently, he some 4 or 5 year olds watch the stuff, then video taped them. I think he did that in IA.

Good job to the way smart couple for being suspicious of him. It's the people of the country that make the country work. Thankfully the authorities didn't "play this off" as a busy body call, and actually nabbed someone.The pervert needs to be dropped of on Antarctica...without any clothes or previsions.

That has been my position for a long time. We hear criticism of the death penalty as being applied too much. I say it isn't applied nearly enough.

Yeah, the couple did great. I wish more folks would verify SSNs - I think it would be a boon to law enforcement and make the fugitive lifestyle much more difficult.

And if a pattern was detected -- that is, you were in the habit of downloading and disseminating these images...as opposed to one time accidentally opening some spam and downloading the contents.

And it is assured that the ACLU considers the Boy Scouts of America to be a "greater threat" to the American way of life than that scumbag.

Those are the states that are mentioned, but he had to get there so he went through every state in between those, and it also says that he was a trucker, so there likely arent any states, or cities/towns/villages, that could rule him out.
