I don't know if you could get a California judge to issue a rule 11 order on something like this.
Seriously, I don't know why the automakers don't simply shut their operations in CA completely. They aren't making money there anyway (or anywhere else for that matter). Let the fruitcakes reap what they sew.

Even admitting that global warming is occurring, the human contribution is some incredibly tiny amount. The automobile's contribution is a fraction of that amount. The state of California is a small fraction of the Earth itself. So perhaps a jury could award California the princely sum of .00001 cents per automobile produced to cover the automobile manufacturer contribution to California's global warming problems.
Of course, this scenario depends on the presiding judge not laughing the case out of court, so the probability of it actually occurring is miniscule.
Next stop: the whole Western civilization, as the industrial revolution starting in the West has created the global warming in the first place. At least that's what my high school teacher said.
You may be right, but I note that the suit is going to be brought in federal court, and leaving aside in what way the plaintiff could possibly show that their "factual contentions have evidentiary support", how is the state of California going to hold automakers liable for damages when those automakers followed the emissions standards mandated under California law.

Lockyer is running For State Treasurer. He is now Attorney General. All this amounts to is free publicity and campaigning on the taxpayers dime.

These people are not stupid. They would not have gone to court had that been the case. For years now they have spens exorbitant amounts of money in an effort to "stem global warming". They will simply link those costs with the automakers emissions and blamo! More bleeding in Detroit...

The argument is moot. Cars only pollute when they are used. If oil is not changed for example as recommended or a cleaner grade of fuel, its the fault of the user! A car in a garage will not pollute. I think that car manufacturers should have no problems proving its the user is the polluter!
