I sure wouldn't want to be the hapless staff counsel who signs the pleadings in this case. After notice, and a reasonable opportunity to respond, I predict it's Rule 11 time.

Well, knowing Lockyear, this is no surprise.
Calif is controlled by the Dems, though currently led by a RINO.
The whackadoodles run Calif for the most part.

I don't know if you could get a California judge to issue a rule 11 order on something like this.

Seriously, I don't know why the automakers don't simply shut their operations in CA completely. They aren't making money there anyway (or anywhere else for that matter). Let the fruitcakes reap what they sew.

Wrong.
Calif needs to sue the Sun.
If we could extinguish the Sun, we'd extinguish global warming.
Of course, it would extinguish all life except perhaps some bacteria, but hey! You can't have an omelet without breaking a few eggs. At least the zero pop growth folks who want the human pop reduced by 90 or so percent would be happy. Always a bright side you know.

Calif: the land of fruits and nuts (state motto)

It is not the car that emits greenhouse gases....it is the fuel burning that does it. Go sue Big Oil. :)

"The injuries have caused the people to suffer billions of dollars in damages, including millions of dollars of funds expended to determine the extent, location and nature of future harm

How can a state or anyone sue for FUTURE harm when there's a question of if there is to be ANY harm to be done?

I actually look at this as a good thing. Once and for all the myth of human-caused global warming can be debunked. The auto company lawyers can present all the facts and statistics to prove it.

Al Gore will have to shutup. The enviro-weenies will have to find another issue to whine about. Thousands of useless idiots who have dedicated their lives to this non-issue will have to find productive jobs.

Even admitting that global warming is occurring, the human contribution is some incredibly tiny amount. The automobile's contribution is a fraction of that amount. The state of California is a small fraction of the Earth itself. So perhaps a jury could award California the princely sum of .00001 cents per automobile produced to cover the automobile manufacturer contribution to California's global warming problems.

Of course, this scenario depends on the presiding judge not laughing the case out of court, so the probability of it actually occurring is miniscule.

Next stop: the whole Western civilization, as the industrial revolution starting in the West has created the global warming in the first place. At least that's what my high school teacher said.

"I don't know if you could get a California judge to issue a rule 11 order on something like this."

You may be right, but I note that the suit is going to be brought in federal court, and leaving aside in what way the plaintiff could possibly show that their "factual contentions have evidentiary support", how is the state of California going to hold automakers liable for damages when those automakers followed the emissions standards mandated under California law.

Lockyer is running For State Treasurer. He is now Attorney General. All this amounts to is free publicity and campaigning on the taxpayers dime.

The suit will be tossed.

They would have to PROVE the science in court

These people are not stupid. They would not have gone to court had that been the case. For years now they have spens exorbitant amounts of money in an effort to "stem global warming". They will simply link those costs with the automakers emissions and blamo! More bleeding in Detroit...

How did they get the tobacco settlement when it was a legal, regulated and taxed product?

The argument is moot. Cars only pollute when they are used. If oil is not changed for example as recommended or a cleaner grade of fuel, its the fault of the user! A car in a garage will not pollute. I think that car manufacturers should have no problems proving its the user is the polluter!
