Where did you get that idea? It certainly wasn't from the text of the Constitution. JFK didn't resign his senate seat prior to his election, and Warren G. Harding didn't either. Senator Dole voluntarily gave up his position as Majority Leader mainly due to fact that his campaign had quagmired. It was intended to be a bold move to reinvigorate his campaign.

Bill Clinton is NOT consitutionally ineligible to be President. He is only ineligible to SEEK ELECTION to the Presidency.

There is NO explicit provision there that bars an ex-President from seeking election to the Vice-Presidency. Now, you may think it is implied, and I certinaly agree that it is a good idea, but sorry, it is NOT explicit.

This provision potentially bars certain individuals from seeking election to the Presidency. It does not bar them from seeking election to other offices, including the Vice-Presidency. Only individuals "constitutionally ineligible to be President" are barred from seeking election as Vice-President. Bill Clinton is NOT "Constitutionally ineligible" to hold the office of the Presidency.
Morally, ethically, judgementally, ideologically unqualified and ineligible, yes. For sure. But "constitutionally ineligible? No.

If an individual is barred from holding office more then 2 terms, then how can his being in line to assume office be legal under the Constitution?
