Limbaugh surrenders on drug charge

Conservative talk-show host reportedly reaches deal to settle Rx rap

WEST PALM BEACH, Fla. - Rush Limbaugh and prosecutors in the long-running painkiller fraud case against him have reached a deal calling for the only charge against the conservative commentator to be dropped if he continues treatment, his attorney said Friday.

Limbaugh was booked on a single charge that was filed Friday, said Teri Barbera, a spokeswoman for the Palm Beach County Jail. He left about an hour later, after Limbaugh was photographed and fingerprinted and he posted $3,000 bail, Barbera said.

The radio giant’s agreement to enter a diversionary program ends a three-year state investigation that began after Limbaugh publicly acknowledged being addicted to pain medication and entered a rehabilitation program.

This is how the MSM is trying to spin this story this morning. It isn't what they wanted, and they are terribly upset and disappointed. So they toss out the headline with the word SURRENDER - only to admit in the story that all he did was plead not guilty, which will be accepted.

Par for the course. This weekend, the movie "Flight 93" opens to much anticipation around the nation. What is the headline on AOL News? Flight 93 - right? Wrong.

It would be nice if now someone went back and took a good hard look at the prosecutor. If they can't find some dirt under his fingernails, that would be a surprise.

The insidious part is not the current event, it is the historical perspective.

Many years from now, as we talk to our grandchildren about the roots of conservatism and how a few voices helped keep the movement alive during some dark days, they will do a search on the name 'Rush Limbaugh' and find this headline.

They will not have the perspective to understand what really happened. They will just think that the 'good' people on our side did bad things so it must be OK for everyone to do 'bad' things....it doesn't stop you from becoming famous or well-liked.

Notice the slippery way they describe the resolution of the charges, by using remarks like "Limbuagh's attorney siad . . ." The cannot even objectively report that this is what the deal was. Rush comes out of this smelling like a rose. The PBC State's Attorney wouldn't have made this deal if he thought he had a reasonable chance of winning the case, and that in Florida's most DemonRat infested county.

Dude, at least be honest about it. The guy messed up and should have to pay for it. Public ridicule is part of that process, and if it serves to keep him on the straight and narrow, then it's a good thing. I enjoy Rush's program, but he messed up, so it's time to pay the piper. He's not above the law just because he's a conservative icon.

Rush tends to be quite an arrogant guy, so all this negative publicity was coming to him.

Let's face it, Mr. Family Values Limbaugh has been divorced 3 times, and has no children, adopted or natural.

Mr. Super Patriot has also never served in the Armed Forces.

They call it a "diversion" program, but I've prosecuted many cases that went the pre-trial diversion route and I never did one that included a not-guilty plea.

I will not judge him, however I have never heard the guy claim Jesus Christ as His God so he may by just a atheist radio jock ....

Heck I don't waste time listening to O' Rielly either.

Conservative Catholic is my claim and 17 seconds out of confession I mess up again...

I don't think the headline or the article was inaccurate. Many people have been complaining that Rush shouldn't be treated any different than anyone else under similar circumstances. Except for this being front page news -- he is a celebrity -- the disposition that he received for a first offense is SOP.

While I'm not sure of the technical name of the disposition in Florida, in New York its called an "adjournment in contemplation of dismissal," and in Federal Court, its called a deferred sentencing agreement. Basically what happens is that the person is formally arrested and arraigned and a not guilty plea is entered. The court, the prosecutor, and the defendant then agree that if the defendant behaves himself over the next six months, a year, or whatever, the charge will be dropped and the slate wiped clean as if the person was never charged and arrested in the first place. If the person is arrested on a similar charge (or sometimes any charge) during the deferral period, then the initial charge is reinstated and the person runs the risk of conviction on both charges, which usually results in a more severe sentence. Also, sometimes the court imposes certain conditions during the deferral period, such as drug/alcohol treatment and/or community service. Like I said, this is SOP.

I think that by then everyone, not just political conservatives, will regard what we now call the mainstream media the same way the Soviet or Nazi press is viewed.
