Judge: No Deal For Teacher Who Slept With Her Student

OCALA, Fla. -- A Florida judge said a plea deal for a Tampa teacher accused of having sex with a 14-year-old would "erode public confidence in" schools.

Marion County Circuit Judge Hale Stencil has rejected the plea deal for Debra Lafave, 25. The judge said the deal would undermine the credibility of the criminal justice system.

Prosecutors and the defense lawyer had urged the judge to accept the deal for the good of the boy. A psychiatrist told the judge the boy suffered extreme anxiety because of intense media coverage of the case and does not want to testify.

Lafave was charged in two counties where she's accused of having sex with the student.

A judge in Hillsborough County accepted a plea deal there in November and sentenced Lafave to three years of house arrest and seven years' probation. She pleaded guilty in November to two counts of lewd and lascivious battery for having sex with the boy in a classroom and her home.

So, you're seeing it through innocent eyes, I'm seeing it from the world I've lived in most of my life.

I understand your point, certainly.

Especially with young girls. I've seen surveys claiming that more than half of all women have been abused. My wife was 'fondled' on several occasions as a child, once by a family member, and it still affects her to this day.

Back then, no one told young ladies about the dangers, no one talked to kids about what to do if anything like that happened.

I have tried to be very open with my daughter, and prepare her for exactly how to react.

But of course, even with the best of planning, sometimes . . .

I am not defending her, the boy's mom refused to allow him to testify. No case. No trial no punishment, other than parole. I pray she is a blessing to her new husband. She was married (2nd) last week.

I'm wondering if her reference to "I've lost family" is referring to her hubby. It was her 2nd husband? Already? What happened to the first one?

I was just jesting about the difference between boys and girls in the same position. In reality I would smack the boy upside the head if she were married let alone other considerations, i.e. unmarried & unprotected & you don't know this girl & a million other things......But man she is good looking..MUST FIGHT THE BLONDE URGE.......

I listened to the taped phone calls.

She sounded like she was a junior high school kid herself.

It sounded -- to me -- like she liked the excitement of youthful crushes and did not want to grow up and have an adult relationship --- and especially not the responsibility of an adult relationship: kids, bills, money, etc.

Read my post again - I said it wasn't his fault, thus it was hers. I think it is safe to say that 90+% of 14 year old boys would have done her if she came on to them, if you are too stupid to understand that then I can't help you out any more.

The ONLY blame you put into your first post was not blaming him for wanting "that".

No blame at all for her...none at all....If you cleared that up in a later post I must have missed it. However, as you can clearly see your first post says nothing about her being at fault in this at all.

I'm sure you've been flamed to a crisp here, so I'm going to agree with you... Sort of...

I seem to recall that when I was 14, "I was so horny that the crack of day wasn't safe!" Yes, 14 year old boys tend to be full of hormones, and will do amazingly stupid things for the attention of girls in general: Which is why it's so important that 14 year olds SHOULD NOT BE HAVING SEX in the first place! They don't have the emotional maturity to think over the consequences of having sex, or doing the things that they think will get them sex.

At 14, I would have jumped at the chance to have sex with her. Heck, at 44, I'd still jump at the chance... Well, maybe, she's awfuly cute... But that's not the point.

The whole point isn't what the boy should have done. It's that she should never have put the boy in that situation. That's where the problem is. You've got an adult in a position of authority who's taking advantage of a young boy, plain and simple. I honestly think that it would be different if the boy were 18, 17, and maybe even 16, as far as the possible damage that she might have inflicted on the boy. But 14 is way wrong. Even at 18, she should lose her teaching certificate, but there shouldn't be criminal charges. But for having sex with a 14 year old boy, yes.

I posted a lot of later posts clarifying that statement, I did rather assume people would understand that it wasn't his fault at all, that she was the adult and she is completely the guilty party. Guess I should have been clearer in my first statement.
