OCALA, Fla. -- A Florida judge said a plea deal for a Tampa teacher accused of having sex with a 14-year-old would "erode public confidence in" schools.
Marion County Circuit Judge Hale Stencil has rejected the plea deal for Debra Lafave, 25. The judge said the deal would undermine the credibility of the criminal justice system.
Prosecutors and the defense lawyer had urged the judge to accept the deal for the good of the boy. A psychiatrist told the judge the boy suffered extreme anxiety because of intense media coverage of the case and does not want to testify.
Lafave was charged in two counties where she's accused of having sex with the student.
A judge in Hillsborough County accepted a plea deal there in November and sentenced Lafave to three years of house arrest and seven years' probation. She pleaded guilty in November to two counts of lewd and lascivious battery for having sex with the boy in a classroom and her home.
Indeeeeeeeeeeed!
I believe the judge has just thrown the case out of court!
Justice prevails!
Life experience.
A girl who is loved and left by a sexy guy typically regrets the experience. A guy who is loved and left by a sexy girl pretty much *never* regrets the experience.
I understand this is currently against our laws.
I'm just saying I believe that is silly. I guarantee you this boy does not feel 'victimized'.
Are you male or female?
Ive been a guy for quite some time, and so I am somewhat of an authority on this, and boys only regret liasons with ugly girls, and then only if their friends find out.
Thus the old joke: What is the diff between a moped and a fat or ugly girl?
None, really....
They are all fun to ride till your friends see you on one.
;-P
THAT rocks!
Thank you, it made my day & reminded me of some great VH shows I saw as a kid.
Which thus circles back around to my theory that guilt and innocence should be judged solely on the basis of how good looking the teacher is. In this case, therefore, the government ought to pick up the tab for Lafave's legal fees.
"I assume you are speaking from experience?"
Irrelevant, and "no."
Hmmm -- but drugs mess people up.
Are you arguing this boy will be messed up for life? I just don't see it.
I don't see a victim here.
In this case, if justice isn't blind, it's likely to go blind...
"But still... unusual post for someone on a "conservative forum".
Not all conservatives lack a sense of humor.
I don't buy that. He's no less victimized, it's just in a different way.
She should spend 5 years of (MY) house arrest.
I'm a guy. He won't feel ashamed, believe me.
He might not tell his bride, in fear of her being upset. He *will* remember it at his wedding day, and for the rest of his life -- fondly.
Guys are different than gals. One of the biggest differences is how we feel about sex. I just don't believe you can call this boy a 'victim', I'm sorry.
You feel like such a victim when you are bragging to your friends, and they pile addoration and envy upon you.
I disagree: he's very much a victim. However, the 14-year-old boy would probably go to his grave never realizing what a victim he was...
Ah. I thought you meant "hornormaly".
So...it's ok if a sterile teacher gets it on with a 14 year old girl? Is it ok if she doesn't get pregnant? If he uses protection?
You obviously don't understand how mindless you sound, or you wouldn't be posting this.
Now there, you've got a point. If she had given him a disease, or gotten pregnant, *then* the boy might have been a victim.
On your first point, I'm not sure he'd regret it even if he went thru such a life-change. Maybe it's just me, but I don't think guys regret experiences like this much.
"Are you arguing this boy will be messed up for life? I just don't see it."
Drugs and alcohol and tobacco present a danger --- not a guarantee --- that someone will be "messed up for life," a danger society considers too great for children, as a group.
Lot's of time, there is a crime, even when no one is hurt -- go run a stop sign in front of a cop. Even if there is no accident, you'll get a ticket.
Lots of drunks drive home safely every night. Probably most do, in fact.
Here, there is a danger of pyschological problems; difficulty having normal relationships with girls his age (Would you let your daughter date the boy? Of course not.); danger of disease; and danger of being a daddy at 14.
Accordingly, it's illegal.
There is no "no harm, no foul" rule in the law.
