OCALA, Fla. -- A Florida judge said a plea deal for a Tampa teacher accused of having sex with a 14-year-old would "erode public confidence in" schools.
Marion County Circuit Judge Hale Stencil has rejected the plea deal for Debra Lafave, 25. The judge said the deal would undermine the credibility of the criminal justice system.
Prosecutors and the defense lawyer had urged the judge to accept the deal for the good of the boy. A psychiatrist told the judge the boy suffered extreme anxiety because of intense media coverage of the case and does not want to testify.
Lafave was charged in two counties where she's accused of having sex with the student.
A judge in Hillsborough County accepted a plea deal there in November and sentenced Lafave to three years of house arrest and seven years' probation. She pleaded guilty in November to two counts of lewd and lascivious battery for having sex with the boy in a classroom and her home.
I think the judge is just jealous. As a 14 y/o boy, I would have loved the experience, and probably cherished it the rest of my life.
It is different for older males and younger females; there really is a different standard. Those guys should go to prison for a LONG time. I can live with contradictions. We can draft boys, but not girls...we are surrounded by contradictions. God made us differently, and looking at the teacher, I am sure God is a Man.

That is true. So if the boy refuses to testify she will walk. If I was the judge, i would allow the plea agreement.

The same ones who force a man to pay child support for children DNA proves were not his because his "wife" was having multiple affairs behind his back.
The 14 year old would, at the least, have to start paying child support when he reaches 18, if not 16. As an employer (I own drilling rigs), I get lots of just-turned-18 year olds who have BACK child support. (I get the court order to deduct some % of their pay and forward to whomever on a routine basis.)
Matters not how old mom is. Matters how old the child's child is.

You base thuis statement on what?? If no one finds out and she is "tenderly instructed" in the "art of love" who's to say she won't remember it fondly when she's 40.

There are reasons it's a felony ... but I guess you're saying we should decide whether or not to enforce them based on whether or not the victims enjoyed themselves

My comments were towards the boy, not the teacher. The teacher is totally at fault for this, I guess you don't have a 14 year old son or his friends around talking when they don't think you can hear them. By high school age they pretty much know the mechanics of things and add raging hormones into it and all bets are off. Its up to the adult to say no, not the kid, thats why they can't be charged. This teacher needs to go to jail, the boy shouldn't be faulted for being seduced by this wacko.

I think the judge was stupid not to accept the plea bargain. If the boy refuses to testify, the prosecution will probably have to drop the charges.

Kids who abuse drugs remember their highs fondly, too.
By this "it felt good to the victim" logic, it should be OK to sell drugs to kids.
FYI I read elsewhere that the prosecution as already dropped the charges.
