This is not a crime here but an alleged tortuous act. This is a lawsuit and not a criminal case.

When one takes out liability insurance one is insuring against claims that one's own negligence or inaction has caused another individual tortuous injury. Automobile insurance and home owner's liability insurance is an example.

The plaintiffs allege that Google has caused them injury. If Google is essential for a person's business to survive then Google becomes an "essential facility". Google is then liable for the plaintiff's loss.

Do not worry, though, Google has billions of dollars ready to pay the very best lawyers and buy the most powerful politicians.

I am not a lawyer. This is not advice but an answer to your question.

You are right of course, but I still don't think they should be sued over it.
