Napolitano on FNC says the judge must consider things like the helplessness of the victim, and the heinousness of the crime according to the FL statutes. Sounds to me as if the judge would have a hard time overriding the jury's recommendation for the death penalty.

I'd prefer he first get a few lessons in what needle-nose pliers can do, and then get that 'other' needle.
