WASHINGTON (AP) - New Supreme Court Justice Samuel Alito split with the court's conservatives Wednesday night, refusing to let Missouri execute a death-row inmate contesting lethal injection.
Alito, handling his first case, sided with inmate Michael Taylor, who had won a stay from an appeals court earlier in the evening. Chief Justice John Roberts and Justices Antonin Scalia and Clarence Thomas supported lifting the stay, but Alito joined the remaining five members in turning down Missouri's last-minute request to allow a midnight execution.
As I understand it, this is just a temporary delay. I think AP is just trying to make trouble.
Well, obviously this one vote is proof he's another Souter. I'll never vote for another Republican again. </hysteric Freeper response>

More than likely, he did not have sufficient time to review the case and chose to stay the execution to give him time to do so.
It is common to make otherwise fireable mistakes on your first day at work (depending on the job of course).

When they have to lie to make a point, they don't have much of a point.
When I was driving home this evening, the news on the radio was reporting this as a 9-0 decision. Curious.

regardless of political leanings as a first act as SC Judge to not allow review of a death penalty case would be harsh.
but then again the way the dems were talking I thought he was going to personally execute every woman and black on the day he was confirmed.

He voted WITH everyone else and it was a 9-0 decision.
It's only temporary also.

Well, I don't think we should execute Missouri either, afterall there are a lot of good people there.
