DNC: BUSH IS LYING ABOUT BRIEFING CONGRESS [Byron York]

The Democratic National Committee has just released a statement which appears to claim that the president is lying when he says the administration briefed members of Congress on the NSA spying program:

With his credibility in tatters, President Bush may have fielded questions, but he failed to explain why he may have ignored both federal law and the Constitution in ordering the NSA to spy on Americans. This disturbing abuse of power has become a disturbing hallmark of the Bush administration over the past five years. The President now seems to be hiding behind a false claim that he briefed members of Congress. In the spirit of the President's newfound candor, we call upon him to correct the record, explain why members of Congress were left in the dark and support an investigation into this secret spying program...

Have the DNC and Conressional Democrats declared war on Bush and red state America? Increasingly, it feels like it.

A famous maxim has it that the first casualty of any war is truth. Democrats are hacking away at truth with broadaxe ferocity of berserkers annihilating a village on a river raid.

A good rule of thumb to remember when dealing with the leftists, socialist, liberal democrats, the DNC, and most of the MSM is simply this...

Any accusations they are making are in reality an admission of guilt on their part on issues similar to or the same as what they are talking about.

Exactly. They project their own behavior on others because, to them, after all...it is what they do, and they figure the rest must be like them and are therefore open to accusation...except when they have the reigns.

They never contemplate that there are people of reason, principle, honor, and integrity who are not like them at all. It is such people, of reason, commitment, intergity and honor that have made and maintained this nation and its liberty, with the Hand of Providence to support them.

The text below is from a 2002 holding by the United States Foreign Intelligence Surveillance Court of Review. The holding in it's entirety is here. The text is from page 48.

"It will be recalled that the case that set forth the primary purpose test as constitutionally required was Truong. The Fourth Circuit thought that Keith’s balancing standard implied the adoption of the primary purpose test. We reiterate that Truong dealt with a pre-FISA surveillance based on the President’s constitutional responsibility to conduct the foreign affairs of the United States. 629 F.2d at 914. Although Truong suggested the line it drew was a constitutional minimum that would apply to a FISA surveillance, see id. at 914 n.4, it had no occasion to consider the application of the statute carefully. The Truong court, as did all the other courts to have decided the issue, held that the President did have inherent authority to conduct warrantless searches to obtain foreign intelligence information.26 It was incumbent upon the court, therefore, to determine the boundaries of that constitutional authority in the case before it. We take for granted that the President does have that authority and, assuming that is so, FISA could not encroach on the President’s constitutional power. The question before us is the reverse, does FISA amplify the President’s power by providing a....."

Peach, can the "Gorelick Wall" be removed after the Patriot Act is null and void? Seems she was appointed to keep intelligence from flowing from one intellegence agency to another. The Gorelick Wall removed any and all avenues whereby the pertinent agencies can exchange information and connect the dots.
