This is a frowny face moment, however there is some value in letting him go. If he is placed under surveillance, and his actions and contacts are documented, he might be a key to a larger group of people who are engaged in criminal activities. (Little fish, big fish.) If he is detained and jailed or immediately deported, a chance to uncover the identity of others would be lost.
