Parents want review of sex survey ruling (Ninth Circus Appeal)

Parents who were outraged that the Palmdale School District had surveyed students about sex are asking a federal appeals court to reconsider its Nov. 2 decision dismissing their lawsuit.

While the surveys asked students how often they thought about sex, among other questions, the 9th U.S. Circuit Court of Appeals said parents of public school children have no "fundamental right" to be the exclusive provider of sexual information to their children.

The parents maintained they had the sole right "to control the upbringing of their children by introducing them to matters of and relating to sex."

The court has no timeline when it must respond to the petition for a rehearing.

Follow-up to the FReep thread 9th Circuit Says Sex Questions OK For Elementary Kids which has more background on this travesty. The "court has no timeline when it must respond to the petition." I suppose the won't respond at all.

Good luck, the 9th Circus also ruled that parents have NO RIGHT to have an input on what the government schools teach their children.

The only reason parents exist in the minds of the radical Left is to provide food and shelter to potential appropriately programmed liberals.

Why, in our free enterprise system, can't some entrepreneurial tacticians take down this awful public school system (and the NEA)? The private schools are prohibitively expensive; but why? Any business in the private sector is much better run and much more efficient than government run enterprises. The problem, as I see it, is that people whom want to put their children in private schools still have to pay taxes for public schools. This, in effect, not only saddles them with the premium cost for the better school but also double dips them to pay for others' kids with no benefits to their own families.
I don't agree with the tax code and think it was illegal when it was imposed on our fathers and no less illegal today. Even under the present tax code, however, this seems to be a simple problem to solve: reduce federal and state taxes of those people that enroll their children in private education by the amount that the government taxes each citizen for public education.

Take it to the U.S. Supreme Court. They ALWAYS overturn any decisions made by the out of control, Leftist bozos on the 9th Circus. Everyone knows these so-called "judges" are a bunch of west coast freaks.

My question regarding this mess is this: why aren't these parents (on behalf of their children, of course) suing for Sexual Harassment?

Imagine, if you will, a survey at your place of business containing these very same questions...

The parents should sue the school for sexual emotional abuse of their kids.

Excellent ideas, littleboots. It's called "vouchers". The education establishment and their unions fight them tooth and nail because they know it would be the end of them.

The 9th circus is wrong.

Parents can take their kids out of public schools. Then they can vote to dramatically change the tax structure of their state.
