Where is the reckless driving charge on the part of the driver who attempted to cause a collission.
Sorry. If someone in front of you hits the brakes and you rear end him you're at fault. In this instance the driver may have thought the following car was trying to signal him something was wrong.

Doesn't sound like 55MPH to me.. Sounds like traffic was stopped..
When someone flashes their lights from behind, and I'm not in the passing lane, I assume they are trying to get my attention..
Possibly I have a tail light out, or the car is on fire..
Maybe the driver just wanted to find out what the guy behind him was flashing his lights for..
Beyond all that, if someone is tail-gating me, I will definitely tap my brakes to get them to back off..
The "reckless driver" is the tail-gater..
That happened to me once.
A guy behind was tail gating and flashing his high beams which in the international language of highway driving is a polite way of saying."drop into the slowlane and let me pass"
Instead I revved up to 5000 rpm downshifted into second and hit the gas.
The guy behind me slammed on the brakes and almost went out of control.
I don't blame Flair for being pissed
