an average person would have been dumped into the first time offender pre trial diversion program and the after competing treatment the case would have been dropped. Not dismissed, dropped with no record.

the average person would have even needed a lawyer to go through the process since it is a diversion program.

but prosecutors don't care about average people.

palm beach prosecutors only care about political contributors.

The bar complaint pending is for EXACTLY this type of behavior.

FL Bar ethics prohibit prosecutors from "leaking" for advantage.

So the prosecutor could be made a fool by passing a law to make it a misdemeanor, like the forgery statute?

Yes, that collection of knuckleheads in Tallahassee could theoretically do such a thing as amend Florida Statute 893.13(7)(a)(8), but seeing as they couldn't even prevent a psychotic male nurse with a death fetish from starving his own wife to death over a two week period, I find it highly unlikely that they would succeed.

"I have no idea if Mr. Limbaugh has completed the elements of any offense yet . . . unless we can ask several pertinent questions," Martz told Circuit Judge David Crow.

An obvious fishing expedition. There is no proof of any crime, even they confess, but they want to continue to search, until they find something. This is all political.

I have to sign a paper in my hospital stating that if I give any personal information and violate the HIPPIA Laws I can be fired. Why does the media or anyone need to know about Rush Limbaugh's medical history. If the lawyers need to know, the judge that should be it. The Patient Privacy Laws are there to protect the patient regardless of what the Patient's Problem is. If he did something illegal he should be handled correctly On the other hand why is hollywood given a pass when they are addicted to coke, pot, herion etc. yet Rush is getting the 5th degree not that I am sticking up for Rush, however RX meds can become just like illegal drugs and people can get hooked. It goes for people with HIV or any other illness it is for the Patient to discuss Not the media, newspapers or anyone else it is a violation of the Patient Protection Act and anyone giving information from any health establishment can be charged legally. So I wish the media would get off it. I yearly sign my life away on this Patient Protection Act I am wondering how anyones Health Information get's leaked.

Beating a dead horse I'd say. These people never give up do they? They like to go after the powerful. That's why they don't go after the dem/dumb/lib/lefties. The have no power.

I work with a couple of people who, when they hear Rush on my radio, always have some snide comment about drugs and drug users. Regardless of the final outcome, the damage has been done.

The prosecutor should have let this one slowly drop off the radar screen. He's done all the public relations damage that he could and further prosecution isn't about to put a big time criminal into the slammer.

Why the prosecutor is pressing on and on doesn't make sense.

It makes perfect sense. Democrats will do ANYTHING to hurt or silence Rush Limbaugh. They're intent is to get a willing judge to rule against Rush until they manufacture a guilty verdict from a manufactured crime. The same thing is happening to Tom DeLay.

That is so they can threaten them with trumped up charges if they do not say what they want them to say.

They [the Democrats] are out to get[silence] Limbaugh and will stop at nothing to accomplish their goal.
