Schumer: Miers Lacks Votes to Be Confirmed

A Democrat on the Senate committee that will consider Harriet Miers' nomination said Sunday that President Bush's Supreme Court choice lacks the votes now to be confirmed, saying there are too many questions about her qualifications.

"If you held the vote today, she would not get a majority either in the Judiciary Committee or the floor," said Sen. Charles Schumer (news, bio, voting record), D-New York. On the 18-member GOP-controlled committee, "there are one or two who said they'd support her as of now."

But the committee's chairman, Republican Sen. Arlen Specter (news, bio, voting record) of Pennsylvania, rejected the notion that Miers' nomination was in trouble. Specter said most senators are waiting for the hearings before making up their minds "There are no votes one way or another," he said.

Miers, a longtime Bush confidante who has never been a judge, was nominated to replace retiring Justice Sandra Day O'Connor. The nomination has troubled some conservatives who say it was a risky choice because Miers was a blank slate on issues such as abortion and gay rights.

Democrats, too, have expressed concerns about whether the current White House counsel could sever her close ties to Bush and rule independently once she were on the bench.

"The hearings will be make or break for Harriet Miers in a way they haven't been for any other nominee," Schumer said on NBC's "Meet the Press." "She'll have to do very well there. She has a tough road to hoe."

First indication I have read that Schumer is afraid of her being confirmed. He just can't quite bring himself to admit it's her Evangelico side that he finds worrisome.

Looks like the conservative intellectuals have gotten their way. It will be interesting to see if the result is a more conservative nominee or a more liberal one. I'm betting more liberal.

I don't care, so long as its a more qualified one.
Though it's hard to speculate considering Miers's known ideological record is like Jeckyl and Hyde.

Having been burned once now, my guess would certainly be that Bush will be more careful to select a known conservative at least.

If Miers is such a terrible choice for the Supreme Court, why would such anuses as Schumer and Dean, oppose her???

Way too many contorted rationales floating about. So much ego invested in wanting Miers stopped. It's generating stuff like:

I don't care if the next one is liberal, as long as the qualifications are superb.

What sense does this make? The point is to move the court to the right. If that happens in stealth form how is that bad? The Constitution does not require a Justice to even be a lawyer. Worshipping credentials over personal inclinations doesn't make much sense.

Hell, if you worship credentials over inclination, you will have someone who elevates stare decisis to lofty heights and believes that it can carry the day when there is an issue not explicitly addressed in the constitution.

I trust Bush. But I don't trust the Senate. Whoever gets nominated has got to get a majority of the Senators, and I don't think there are enough conservatives to win an outright war over a conservative nominee.

Sure funny how the people purportedly most concerned through the years about prejudice are now the first to prejudge Miers before her confirmation hearings.

Liberals never let truth get in the way of their anti-American agendas.

I'm eagerly anticipating her hearings....much more so than the Roberts' show.
