Top court okays mass deportations

(ANSA) - Rome, August 8 - Mass deportations of irregular migrants are acceptable under certain conditions, Italy's highest appeals court said here on Monday .

The Court of Cassation ruled that Italian authorities could expel large groups of foreigners for identical reasons so long as each case had been given individual consideration .

The decision overturned a ruling by a Milan tribunal, which found the group deportation of 15 Roma migrants not holding residency permits to be in violation of the European Convention on Human Rights .

Protocol 4, Article 4 of the convention prohibits the "collective expulsion of aliens" .

But the supreme court said this did not apply in Italy, where there were sufficient safeguards in place to ensure that deportation requests were examined on an individual basis, even if the final decision was the same for a number of people .

The fact that several individuals were deported for the same reason was "irrelevant" for the purposes of the convention, said the court .

It underlined that migrants were given adequate protection and the right to legal assistance in making their case to remain in Italy .

The United Nations Refugee Agency spokesperson in Italy, Laura Boldrini, said the decision was a positive one, despite its overall tone .

"The court has underlined the importance of verifying individual cases as well as the safeguards owed each immigrant who is being expelled," she said .

Boldrini also pointed to a recent decision by interior ministers in five European Union states to work together on deporting immigrants of the same nationality. She said that the plan - in which migrants being expelled from Italy, France, Germany, the UK and Spain would be transported out of Europe on the same flight - was akin to collective expulsion .

The collective deportation of migrants has repeatedly made headline news in Italy over the last year, with a particular emphasis on expulsions to Libya .

Over a thousand migrants thought to have arrived from Libya were airlifted to Tripoli last October, while nearly 200 met the same fate in March .

The move sparked widespread criticism among members of the opposition, humanitarian organizations, the United Nations Refugee Agency and the European Court of Human Rights .

In April the European Parliament approved a resolution condemning the expulsions, while Amnesty International has issued several statements warning that collective deportations are banned under international law .

Humanitarian groups claim that any collective deportations risk violating international refugee regulations, as there is the danger individual cases will not be examined properly .

The Italian government, which has made cracking down on illegal immigration a key priority since coming to power in 2001, has defended its collective deportations, stressing that each asylum request is examined on a case-by-case basis .

Sure..... Our Supreme Court has decided that we are to follow the laws of other countries, so it's obviously legal.

Kinda what I was thinking. SCOTUS seems to want to integrate some of Europes laws into our system. This one would be a great addition.

Such a thing did pass muster when FDR deported 2 million illegal Mexicans in 1939. It also passed muster when Eisenhower deported over 1 million illegal Mexicans during his administration.

For the politicians to whine about the system being broken is a pure cop out. I sent a note to Salazar here in Colorado and got back his comments saying that immigration was broken. Total Cop Out.

Lemme guess too, he doesn't do it with a bus. He does it one at a time in a city car. Getting paid all the while, and doesn't need to bother with traffic miscreants or other crooks when so occupied. Were I a kop I think I'd like that.

Whoa-ho-ho! The very phrase "mass deportations" will send the libs into conniption fits. I fully expect a host of Nazi Germany references--more than usual.

So when is our far right-wing Supreme Court going follow its usual precedent--international law?
