Here's what the member of Future Jailbirds of America has on his site:
On March 17 2005, nine Chicago FBI agents raided and seized all electronic equipment in Jeremy Hammond's apartment. Facing intimidation from both the FBI and the Secret Service, he is being accused of hacking into right-wing website ProtestWarrior.com. While the website had not been damaged and no credit cards were billed, the FBI is threatening to charge him with unauthorized access and credit card fraud totalling to millions of dollars in damages and up to thirty years in federal prison for a crime that hasn't even happened.
Jeremy has done no damage to any system and has not charged anything to any credit card numbers. He is being targetted by law enforcement for his political activism and his involvement in running the hacking website HackThisSite.org. If the FBI indicts Jeremy, he faces federal prison and tens of thousands of dollars in legal fees. Support is desperately needed to fight this FBI indimidation and these ridiculous charges!

Conspiracy to commit a crime is a criminal offense itself. Just having the credit card info in his possession is sufficient to get him sent to the slammer.

Reading between the lines on his FAQ page:
These charges are outrageous and reactionary because none of this has actually happened. The website has not been defaced and no credit card numbers has been billed.
He does seem to admit taking the credit card numbers. This is probably what's behind the hysterical demands for the FBI to return the property (which they won't do till they can analyse it). The felony attaches when you take the credit card number, you don't actually have to do anything with it. IANAL but I see at manyt felonies here, and additional counts for every additional card.
Jeremy's friends should not be making any long-range plans with him.

This is just like the burglar who is caught on the property of anothers home with burglary tools but says I did not break in yet.
Based on the PW notice, it seems like this "hacktivist" should be plea barganing not begging for money.
I suspect there is no "threat of prosecution" there is going to be a prosecution. Federal prosecutors just love easy cases.
