I admire Thomas Sowell immensely. He is brilliant. The connection that he makes between "affirmative action" and the selection process for the highest court in the land is 100% correct. Justices should be nominated based entirely upon their suitability for the Supreme Court, and for their faithful adherence to strict originalism.

It's interesting that the liberal media has spent the last 25 years referring to Justice O'Connor as "the conservative Supreme Court Justice," while conservatives said that she was a liberal or a moderate at best.
Now that she's out, the liberals are reversing themselves and say that she should be replaced with a moderate because she was a moderate.

Whether Senate Republicans will have the fortitude and unity to make their majority mean something is another question. The McCain mutiny and sellout against the Republican attempt to stop Senate filibusters by Democrats is a sign that this may be the weak link in any attempt to restore the rule of law in our courts. Don't expect to see much back bone in the Republicans, except the ones who are traitors like McCain and his ilk. Boy they hold on like super glue, as long as the Dems have them paraded on the network news every night they'd betray their own mothers.

Why in the world should Pres. Bush nominate a "moderate" when Bill Clinton gave us Ruth Bader Ginsberg, an ACLU lawyer, and David Breyer, both of whom have voted liberal on every issue tried before them? If Bill Clinton gave the court two liberals, then it's only fair that W gives his voters two conservatives, REAL conservatives.
The squishy "moderate conservatives" always become liberal as they age. There has never been a liberal appointed who has become more conservative over time.

Take Sowell's premise a step further. Why limit yourself to lawyers? Appoint Sowell! Good law clerks could bring him up to speed on arcane minor points of law. He's already Supremely up to speed on certain key points of law, i.e. the Constitution and the principles that framed it, that too many on the bench disdain. The left would claim he's not qualified because of his lack of legal training. But if Sowell were offered and he wanted the job I would pay to watch him make mincemeat out of that argument and all the libs challenging him! He backs down to no one and he's smarter than all the Rats and RINOs combined.

Good article, as usual! However, O'Connor did go out on a high note (her eloquent dissent in Kobe).
That said, I bet Bush is going to "have to" nominate a woman for her seat. This is not the way it should be, but it's certainly something the Dems are going to jump on if he doesn't. Fortunately, there are a number of good women (Brown or Owen, anybody?) who are serious conservatives and would be fantastic on the SC.

Very cogent analysis by Thomas Sowell. Great post. Last night on Fox, Mark Levin ridiculed Sandra Day O'Connor's record. Dems laud her 'pick and choose' approach, that she seemed willing to rule on a whim.(Constitution changing with fashion, trends.) Mark Levin said that was exactly what was wrong with O'Connor. She wasn't shopping in the supermarket -- impulse buying cheese or melons. This was about the law. How would the average person like going to court and facing a judge who'd decide his case on a whim or the trend of the day, not on law. Mark Levin's new book, Men in Black, is undoubtedly a great read, too.

The only thing wrong with Supreme Court is there are too many Lawyers on it.. A Supreme Court with some plumbers, electricians and carpenters on it... and maybe a Leo or two.. would serve "the PEOPLE" better.. they can hire all the legal whores they want as aides..
If the lawyers have not PROVED they CAN'T handle it.. they've proved nothing..
Constitutiional Law seems to confuse actual lawyers..
Lawyers should be outlawed from federal AND state Supreme Courts..
Being trained to argue BOTH sides of any argument addles their brain..
Since most lawyers have no idea that socialism is Slavery by Government.. and a financial glory hole for lawyers.. Well, at least they are ignorant of the slavery thing..

The liberal law school professoriate and the legacy media is already urging President Bush to name a "moderate" Justice O' Connor clone. They want someone who can be depended to vote on them in cases that come before the court. Someone pliable enough will do the job as long as he isn't in the mold of Clarence Thomas or Antonio Scalia. So much rests on the President's pick. And you can expect the Democrats and the liberal special interest groups to put up a brutal no holds barred fight to block a conservative from ascending to the Supreme Court.

This kind of sound reasoning in a man is precisely why I read four books on economics by Mr. Sowell right in a row back in 1982, very soon after first hearing his name. I believe that I received the first one automatically from the Conservative Book Club, forgot to return it (so that I wouldn't be billed), but then was very glad to pay for that book, read it, and ordered three more. Since that time, I've been out of the country a lot and had more difficult access to his books (hard to find them in Red China!). Why doesn't President Bush tap Mr. Sowell for a high economic post?

Justice Anthony Kennedy, once touted by some conservatives as "Bork without a beard" but who turned out to have neither the intellect nor the strength of Judge Robert Bork. THIS is what scares me... I say go big or stay home. A real Conservative SCOTUS nominee is W's only reason for being right now.
