Generally, you can fire someone for off-duty actions that reflect poorly on your company. It's not a neutral act to publicly use your competitor's products. It's a statement against your products. That's not good for your company and is a reasonable basis for termination. Do you think that anybody who makes Dell laptops could use a Mac without peril?

I'm curious. If you walked in to a bar and everyone was in civilian clothes how would you tell if a person is a Bud delivery guy? I think this firing was wrong. The man was on his own time and as long as he was not in a delivery uniform he has every right to drink what he can pay for.

If you think the beer companies are bad about it, PEPSI and COKE are unbelievable. When my law firm did a deal with Pepsi years ago, the Pepsi people (on the other side) went ballistic when there were non-Pepsi products on the sidebar. One partner used to have a Coke brought in for himself just to piss them off!

You gotta wonder if this guy was in the uniform of the distributor. If I was a distributor, and my driver is in a bar, in uniform, drinking the competitor's product, he would be toast.
