Au contraire. Recall that President Ford pardoned former President Nixon for "any crimes he may have committed" before any crimes had been officially charged, much less tried. So it can be done that way.

Actually, hadn't he already been "indicted" at that point prior to the impeachment proceedings going to its full conclusion?
That said, Clinton wrote thousands and thousands of EOs that created laws by fiat, so just because a President did something doesn't necessarily make it right or legal, no?
