CA: LAPD Clarifies ‘Special Order 40’

LOS ANGELES (CBS) Los Angeles police Chief William Bratton Tuesday clarified the department’s policy on the immigration status of people who come in contact with police.

Bratton, emphasizing that the policy had not changed, said over local radio that the immigration status of a person was not relevant to the LAPD unless that person was suspected of a crime.

"’Special Order 40' ... is a policy of the Los Angeles Police Department promulgated by the Police Commission in 1979," Bratton said. "That policy was intended, in 1979, to encourage people who were victims or witnesses of crime to come forward and work with the police."

Bratton said that the policy has become "somewhat misunderstood" over the years by officers and members of the community and was in need of clarification.

Under the policy the immigration status of people reporting crimes or victims of crimes is not relevant to the LAPD, Bratton said. The immigration status of only those suspected of having committed a crime is relevant to the LAPD, Bratton said.

The LAPD is focusing on the "worst of the worst", according to Bratton.

"And within the immigrant population, the worst of the worst are those who have been arrested, convicted, gone to jail, and then have been deported back to their native country, who then re-enter the country illegally," Bratton said.

"That is a 10- to 20-year federal felony -- just coming back into the country again," Bratton said.

"Each year in the city, we arrest over 30,000 people who are in this country illegally, and among that population, we arrest a significant number -- probably 50 to 60 a week -- who fall into that second category: serious felons who by coming back into the country again are now subject to federal penalties," Bratton said.

Bratton is your typical Politician Police Chief, lacking a spine and heavily into PC. You see, he put it so that if some " minority" complains about an officer, he can absolve himself and the Department.

Stupidity.

Every illegal they talk to is guilty of commiting at least one crime - violation of U.S. borders.

Bratton is as useless as his predecessors.

Unfortunately, as I discovered earlier, a first-time crossing is only a misdemeanor. Since you generally can't tell by looking if someone has come in more than once, and if they haven't done anything else that might cause you to check, a lot of crossers, including multiple-crossers, who otherwise keep their noses relatively clean, get passed over. Even if they commit other crimes like speeding or shoplifting, they get a pass, since it is too much hassle to process them for that crime, then jump through the hoops for the immigration violation, and keep them in a cell until something can be done. LA is so big, the cells fill up with the nasty ones too quickly for local PDs to allow space for illegals.

Awwww, I'm sure that the chief is so upset he probabaly makes those 50 to 60 go to extra transendential meditation session until they submit.

You're right. I keep returning the fund-raising requests with notes saying that when the borders are closed and the immigration laws are enforced I will resume donating. How I wish there were a truly viable CONSERVATIVE party. I know there are some out there, but the potential of displacing one of the two dominant ones is almost nil. Very distressing.

What a brain-trust this guy is. If the person is here illegaly, they have committed a crime.

heh, but if the officer KNOWS that the suspect is a KNOWN criminal alien he still cannot act if the perp only commits Social Security fraud and document forgery...

everyday thousands of Social Security scams and ripoffs just dilute the programs just that much faster

CRIMINAL ALIENS - just doing the crime citizens don't want to do

For the record, the LAPD does not check to see if inmates were sent back to Mexico prior to their current incarceration. Neither do state prisons.

We have recidivist murders, rapists, child attackers et al back on the streets once they've served their current sentence.

LAPD has specificly refused to check the status of illegals they pick up. If they are back in this nation for the 1,497th time, the LAPD could care less. This is even true for known gang members.

Go figure...

The Youth Authority used to hold em until INS cleared them. INS had someone come around to the YA facilities once or twice a month to screen them and then make a determination. Doesn't the department of corrections have a similar process?

This was recently addressed on the John and Ken show, KFI (640) Los Angeles. The answer is no. They were angry that the LAPD will not arrest gang members who have been kicked out numerous times before. They were also angry that illegals who have been convicted and have served time for serious crimes, are NOT deported.

As long as an illegal is not wanted for a current infraction, the LAPD is not interested.

My contempt for Cardinal Mahoney includes his desire for the Catholic church in L.A. to be a sancutary for illegals. I have the same problem with the current police chief and the current L.A. County Sheriff.

These folks have gone over to the other side.

If the person is here illegaly, they have committed a crime.

They get a free pass, I suppose.

Meanwhile, I have yet to get a response from Bratton or Bush as to which laws I am allowed to break and get away with...

I'm in socal and a former Times reader. The LAPD and SO has been worthless on this issue as far back as I recall. I thought maybe corrections was having INS pick up illegals when they parole, but I don't know for sure if they do.
