11 illegal aliens caught, then released in Fairfax
The Washington Times ^ | 04/13/2005 | Gary Emerling

Posted on 04/13/2005 2:21:41 AM PDT by pageonetoo

Federal authorities released 11 illegal aliens who were detained during a traffic stop in Annandale because immigration officials said they did not pose a threat to the public.

"The 11 passengers were processed and released," said Ernestine Fobbs, a spokeswoman for the U.S. Immigration and Customs Enforcement (ICE) agency. "There were children involved, so it was better that we released them."

Authorities ordered the 11 Mexican nationals, three of whom are children, to return to immigration offices tomorrow for further processing. Ms. Fobbs said officials do not know where the illegals are in the meantime.

"It's up to them whether they come back," she said. "If they do not, they will be considered fugitives, and once we do encounter them again, they'll be removed from the United States. They stand to lose a lot if they do not appear."...

..."It highlights the problem that immigration violation is a federal offense and a state or county officer does not have the authority to detain them for a federal offense," Mr. Albo said. "You get your hands on them, and you have no authority to do anything."

A Virginia law enacted last year allows local law-enforcement officials to detain illegal aliens who are suspected of a crime, have been previously convicted of a felony or have been previously deported or left the U.S. after a conviction and illegally returned. Police also can detain illegals for up to 72 hours without bail until they are taken into federal custody.

Under the state law, there is no authority for a local law-enforcement officer to arrest a person solely for being an illegal alien.

I went to visit my Dad in DC on Monday (had to bury his brother in Laurel, MD). On the way, through MD and DC, I saw pockets of "guest workers" standing around in parking lots, and designated pick-up" spots. I saw more than hundreds...

Maryland has the same attitude as VA. We are doomed, with these kinds of politicians in charge...

Unfortunately, our Prez has already bought it...

Catch and release. Why were they undersized or something? Not the season for "Mexican Undocumented Workers"?

EVERY SINGLE ONE of the "federal agents" involved should be fired. It is clear they work for them, not us!

Yeah right I'm sure they'll be there as requested.

"There were children involved, so it was better that we released them."

"It's for the children"

."It highlights the problem that immigration violation is a federal offense and a state or county officer does not have the authority to detain them for a federal offense,"

BS!!!! if there were firearms or drugs involved the local/state would surely hand them over to the fedscum.

I JUST WANT TO SCREAM AT THIS KIND OF CRAP!!!!!!!!!!!!!!

Now, now, calm down. Had they been arrested and detained there could have been a charges of racial profiling filed.

Just think how bad that would make the involved LEO departments look.

Yep. Every one of the Federal agents involved should be fired, but they won't be. They will probably get performance awards.

Until we "fire" the political leadership of this country - both Republicans and Democrats - for actively working against the sovereignty of the US, we will not have effective enforcement. In fact, legality will be continuously redefined so that ultimately the current illegals will be legal and entitled to full protections in the US and those concerned about this issue will become criminals.

Where are the massive protests ??????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????

Back in the old days, when we walked to school, and learned about reading, writing, and 'rithmatic, I always heard reference to "civil servants".

There have been no "servants", in a long time... With unions, and unions, and more unions, the gum't has fallen prey to leftists and big gum't types (did anyone say Bush?). The last thing they want to do is "work". Hell, that means they would be doing something useful, and depriving someone else of a gum't job opportunity!

The Pledge of Allegiance states:

I pledge Allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, indivisible, with Liberty and Justice for all.

Their only allegiance seems to be to their own safety and comfort...

The thing is, I have a lot of respect for LE type folks. Just like the guys in Iraq putting their jewels on the line.

But this was not an LE decision, it was a beurocratic paper pusher decision. A lifer who doesn't want to make waves and is thinking about their pension.

Makes me ready to watch "Braveheart" for the 200'th time!!

"Now that's taking homeland security seriously!"

I voted for GW twice, but on illegal alien policy he is dead wrong.

I'm a naturalized citizen who came here legally. I find this lack of respect for the law an insult to me and the rest of my family. I'm also married to an American woman of Mexican dissent. She thinks Bush is wrong as well on this issue.

If being an illegal alien means you have committed a federal crime, why would any law enforcement officer need another law to have authority to arrest/detain the criminal?
Can not any law enforcement apprehend any criminal?
I just got through reading about several cases where ordinary citizens detained fugitive criminals until police arrived.
Stop the insanity already!

So I guess it isn't "illegal" to be an illegal alien? Our immigration laws are just a joke.

Now that's taking homeland security seriously!

It really jacks me up to think that we have the Minutemen, and now the Yuma guys (and others yet to be mentioned), out there showing the Mexicans the way home, and these guys are inviting them to play house!

I have built almost 500 houses as a general contractor. I did not ever employ an illegal knowingly. If I found out that I had one, I would have removed him so fast it would make your head swim. I am so AGAINST this invasion from the south, which our Pres seems to desire, even encourage!

I voted for W twice. I was fooled, but no longer think he is worthy of the term "conservative". He's a big gum't "middle-of-the-roader:...his ACTIONS SPEAK LOUDLY!

Methinks the people who make up the U.S. Immigration and Customs Enforcement agency top "officials" must have fallen off the turnip truck just ahead of these illegals!

Ridiculous numb noggins!

I just heard last night there's a bill in the General Assembly here in NC to be it easier for the children of illegal aliens to attend college! No mention of making it easier for American children to attend college, just illegal aliens. Something is very wrong with this picture!
