My reaction exactly. If this kind of surveillance were not allowed - Al Qaeda would construct network nodes by intentionally getting key people into prisons in the US.

He's saying that in war, treat the enemy like a typical criminal case during peacetime.
The enemy has written on CDs that they will use our cautious legal system, to have us confound ourselves, to our harm.
