Appeals Court Rejects Terri Schiavo's Parents' Religious Liberties Arguments

Clearwater, FL (LifeNews.com) -- In a decision released Wednesday with no written opinion, Florida's Second District Court of Appeal denied an appeal filed by the parents of disabled woman Terri Schiavo saying that starving her to death would be a violation of her religious liberties.

Bob and Mary Schindler argue that euthanizing Terri would abrogate her First Amendment religious rights. As a Catholic, Terri likely would agree with the church's position against euthanasia.

The Schindlers pointed to recent comments against euthanasia and assisted suicide by Pope John Paul II. The pontiff has said that removing the feeding tube form a disabled patient like Terri constitutes "euthanasia by omission."

The appeals court's decision upholds a ruling by Circuit Court Judge George Greer in October also denying the religious liberties arguments.

Terri's estranged husband Michael praised the appeal courts decision in a press release from George Felos, the euthanasia advocate who is his lead attorney.

Michael called it a "prompt and definitive denial of the Schindlers' frivolous claim."

In an email to LifeNews.com, Terri's father Bob Schindler said he was surprised to lean that Felos had issued the press release before the court notified the Schindlers' attorneys of the decision.

Schindler says the appeals court "did not file an opinion because they could not find any legitimate explanation to reject the appeal motion."

When the appeals court's decision is finalized in fifteen days, the stay put in place by Judge Greer will be lifted. At that point, Michael will again be able to tell doctors to remove the feeding tube.

If removed, medical experts say Terri will die from a seven to ten day painful and agonizing death as she is denied food and water.

The Schindlers can ask the appeals court to rehear the motion or can appeal the decision to the Florida Supreme Court, which has previously ruled against them.

In either case, a new request of Judge Greer must be made to issue another stay preventing Michael from taking Terri's life.

Ackkkk! Here we go (again). I think the religious liberty argument was weak...the bottom line being that her right to LIFE is violated by killing her (for her own good, of course). There should be no question here, no case, no legal wrangling. When she abstained these injuries, the law allowing the pulling of the feeding tube did not exist. This has stunk to high heaven from the beginning...but I really thought that a different path (in this round)should have been pursued. I knew the religious liberty angle wouldn't fly. :(

I think this has gone way beyond that. MS has dug in his heels, out of stubborness and meaness. He needs to WIN...that is his motivation now (IMO). He is also full of crap (all his lies about what Terri would want-what a crock).

Bingo.

Keep this going thru the courts as long as possible but if the courts finally leave no way out and no restraining order Jeb should remind everyone he controlls the men with guns and stop this from happening.

The FL legislature would NOT recall or impeach him over this.

Here is my e-mail to those who have me on their lists:

please remove me from your lists and contact me when and if you want me to join you in front of government officials with my evidence or in whatever influential forum to fry those who attempt murder on terri. if terri dies the blood is on president bush and governor jeb bush's hands (among others) and they will will be considered by me the true terrorists. while others may attempt to sweep terri's life under the rug after the fact and let them forget it i will not. i will always be a time-binder so i will always see through their lies. do not send me news of terri's death if it comes to that. i will not forget about who's hands her blood is on. is it not sad that the list isn't a small one. this is a sad commentary on where we are at as a society. if terri dies i don't want to be anywhere near them when their karma comes to exact recompense in their future. they do not know the story of the 10 good men. they are sorry caricatures of what is good.

I'm not surprised. This isn't the first time Michael has sent out a press release regarding a court decision before the court notified anyone else.

Michael has decided to stop participating in any of the lawsuits involving Terri's family. He doesn't need to participate. He's represented by Judge Greer. It's pretty convenient to have the judge acting as your own personal attorney.

I disagree.

One can be sure, the shakers and movers in FLA are not interested in Michael Schiavo's financial future.

What they are interested in is setting precedent so that they may pursue murdering anyone for health reasons, so that they may take over other's wealth.

Nursing Homes big winners in death's lottery. Retirees deed net worth to Nursing Homes, upon death, and there are those in FLA who just can't wait for nature to take it's course, when they stand to profit.

Organized Crime will have complete control of most nursing homes soon, as it has a high profit potential, given the right laws in effect. Abortion clinics, same thing, different age of the victim.

I think he is just disgusted that the governor doesn't just take Terri into protective custody, then tell the court to call their army and set her free if they so choose.

Politicians have for too log found it easy to advance their true agenda and blame the courts, when in fact they have the authority to limit the courts power.

Justice Marshall has made his decision. Let him enforce it.

Enough already!! I think it's time to do something drastic - I've had a belly full of Michael, Felos, Greer, Baird,et al.

Terri's Life in Grave Danger

This afternoon, attorney for Michael Schiavo, George Felos, issued a press release praising the 2nd DCA's (District Court of Appeal) decision to deny Terri's family the right to a new trial based upon her rights to religious freedom.

Felos wrote, "There is currently no stay preventing removal of the feeding tube in the constitutional litigation between MICHAEL SCHIAVO and Governor Bush, now pending in the United States Supreme Court."

Felos obviously finds great pleasure in adding such a statement to his press release . He boldly hints in his press release that he will quickly file a motion to have Terri's feeding tube removed.

Please be prepared to organize a vigil at Woodside Hospice in Florida

For all practical purposes, there are no "appeals" courts in FL. The courts there are in lockstep on everything relating to poor Terri. It's as if the newly-reelected and popular George W. Greer has a direct pipeline telling the higher courts what they must do in this case. And FL people take the abuse: indeed it is self-inflicted by those voters!
