LYMPIA, Wash. -- The Washington Supreme Court has rejected the petition from the Democratic Party to include previously disqualified ballots in the recount.
The decision was unanimous by all eight justices who heard Monday's arguments in Olympia.

The decision involved about 3,000 ballots that could have changed the race for governor.
Democrats said the ballots should not have been excluded because counties use different standards for disqualifying ballots.
Republicans argued that it would be wrong to change the rules at this point.
The recount will include only ballots originally counted.
Sounds like they have to return them to the lost&found.

That's what I was wondering. I think it 'should' at least keep them from being counted as well, seeming as how they wern't counted the first two times, being deemed invalid.

Rossi is going to lose. He is no match for the institutional corruption in Wa. The libs (DNC) will 'find' as many votes as is necessary.
I'm not sure it includes the 561. Believe me, if it disqualifies those too, then the dems will take it to the federal courts. A Rossi win would be icing on the cake for the already despondent commie, pinko, anti-american scum in seattle. Hopefully the suicide rate will have a huge spike!!!
It is good news... Still sorting out whether this is the last word, or if these other newly found unverified absentees will now count.
It sounds like the Dems are running out of places to find votes for Gregoire. I'm cautiously optimistic that Rossi will prevail.
Not clear what effect it has on the 561 King county ballots -- the decision says you can't change the standard to include votes that were previously rejected, but the 561 in question were supposedly rejected erroneously, so counting them doesn't involve applying a new standard, just correcting an error in applying the old standard.
I have to say: I did not see this coming.
Although Washington's Supreme Court is a bit less loony than Oregon's.
I was watching the newscast this morning - it was hilarious. One of the (dem, I believe) poll workers said he was going through the list of disqualified ballots, and found his name on the list, so he decided to raise a stink.
He was one of the stupid ones that didn't sign the ballot envelope. So he wants his vote to count, even though he didn't sign it. And of course, I assume he believes that ALL the other ballots that weren't signed were cast by dummies (er - democrats) just like him.

You can't change the rules in the middle of the race.
In this context, a ballot is a physical or electronic record of the choices of an individual voter, or the physical document on which the voters choices are to be recorded. RCW 29A.04.008(1)(c),(d). Recount means the process of retabulating ballots and producing amended election returns . RCW 29A.04.139 (emphasis added). The procedure for recounts is set forth in RCW 29A.64.041, and starts with the county canvassing board opening the sealed containers containing the ballots to be recounted. See RCW 29A.60.110. Thus, under Washingtons statutory scheme, ballots are to be retabulated only if they have been previously counted or tallied, subject to the provisions of RCW 29A.60.210.
